Another idiot rent a cop. I have been to the dmv in my area plenty of times oc'ing and never any questions. As a matter of fact when I went with my son to get his learners permit there was a state officer there and he never said a word.

PennDOT licensing centers are buildings owned and operated by the state, to the best of my knowledge...

However, whether or not the policy is legitimate, if you're asked to leave, you have to, otherwise it's still trespassing, even if they don't actually have a policy. It's the kind of thing you have to do as you're told now and figure out who was wrong later.

So even if it's a pre-emption violation in a state building it would still be considered trespassing if you don't leave when asked to?

If a man with a gun is being told to leave a building because he has a firearm, and he refuses to leave, and the people asking him to leave call the cops, what do you think is going to happen?

I'm not saying it's right - the way things should be and the way things are don't always match up. I'm not saying there aren't ways to handle that kind of situation amicably (I did it at WalMart once), but that usually requires being able to convince the other party that they might be wrong, and that you're not a dangerous person. Doesn't sound like the Rent-A-Cop was going to be convinced.

After double checking for spelling and grammer, I sent out the letter via PennDOT's web form. If I don't get a response within a week, I'll adjust the letter accordingly, print it, and send it to Harrisburg via certified mail.

For what it's worth, I attempted to call the Harrisburg main office, they just kept redirecting me to other branches in an endless loop of passing the buck, and I was eventually forwarded to Mr. Kissam's voice mail! Very helpful, there.

I also just contacted my State Representative, Justin Simmons, about the issue. If PennDOT won't speak to me, maybe he can put in a word and get a response. I also linked him to this thread, so please try to keep the lewdness to a minimum.

(a) General rule.--No county, municipality or township may in any manner regulate the lawful ownership, possession, transfer or transportation of firearms, ammunition or ammunition components when carried or transported for purposes not prohibited by the laws of this Commonwealth.

Some people interpret language in the new Castle Doctrine law to mean otherwise.

Two Issues that need processing,report the security to her supervisors for refusing to identify herself so as to make a formal complaint in writing (abuse of authority comes to mind ) Second if I am asked to leave as not being charged with tresspassing and follow up with inquirys (no gun signs were posted ) I OC and have yet to have any issues,but know the day will come,follow up and good for you !

Title 18 PA C.S. 6109:

(m.2) Inconsistent provisions.--Notwithstanding the provisions of section 7506 (relating to violation of rules regarding conduct on Commonwealth property), 75 Pa.C.S. § 7727 (relating to additional limitations on operation) or the act of June 28, 1995 (P.L.89, No.18), known as the Conservation and Natural Resources Act, and regulations promulgated under that act, a firearm may be carried as provided in subsection (a) by:

(1) a law enforcement officer whose current identification as a law enforcement officer shall be construed as a valid license to carry a firearm; or

(2) any licensee.

(m.3) Construction.--Nothing in this section shall be construed to:

(1) Permit the hunting or harvesting of any wildlife with a firearm or ammunition not otherwise permitted by 34 Pa.C.S. (relating to game).

(2) Authorize any Commonwealth agency to regulate the possession of firearms in any manner inconsistent with the provisions of this title.
