    Default Pics Denial

    I was denied by the pics last week.I have owned firearms in the past.. I was blown away. Upon further investigation I discovered I have an M1 on my record for Altered documents(fudging a license plate). I sent out the Challenge forms and called a lawyer and explained the offense. He assured me that I should win the challenge. Also my offense has nothing to do with the 37 listed on the challenge forms but I'm still a little worried. If anyone has any input on this feel free . Thanks

    I'm not so sure. Most M1 convictions ARE prohibiting. The only exclusions I'm aware of are a few that have specific (less restrictive) penalties written directly into the statutes. The 'default' sentence for most M1 convictions prohibits you at the federal level.

    I don't see any such lesser penalty listed in the Altered Documents statute, so I would assume that you are indeed prohibited.
    § 7122. Altered, forged or counterfeit documents and plates.
    A person is guilty of a misdemeanor of the first degree if
    the person, with fraudulent intent:
    (1) alters, forges or counterfeits a certificate of
    title, registration card or plate, inspection certificate or
    proof of financial responsibility;
    (2) alters or forges an assignment of a certificate of
    title, or an assignment or release of a security interest on
    a certificate of title or any other document issued or
    prepared for issue by the department;
    (3) has possession of, sells or attempts to sell, uses
    or displays a certificate of title, registration card or
    plate, driver's license, inspection certificate proof of
    financial responsibility or any other document issued by the
    department, knowing it to have been altered, forged or
    counterfeited;
    (4) obtains or attempts to obtain a certificate of
    inspection without valid proof of financial responsibility;
    or
    (5) provides a certificate of inspection where there is
    no valid proof of financial responsibility.

    Get a new lawyer. The only M1 that is not prohibiting under federal law is cruelty to animals, because the legislature limited it to a maximum term of 2 years.

    Only option here in PA is a Pardon, assuming that you aren't 70 years of age. If you are 70 and haven't committed a crime in the past 10 years, you could have it expunged

    Sounds like you're screwed.

    Also, if you own firearms currently, I don't think you're allowed to possess them anymore.

    So even though its not listed in any of the crimes in the challenge forms I'm still screwed. And i had no idea that this would kill my rights to bear arms. I am a friend of the judge from the hearing if that would help any.

    I fully recommend the "get a new lawyer" idea, and I mean before your hearing date not after.

    I'm not a lawyer, but I don't see how your current attorney's advice is going to do anything other than make it harder to ever own a gun again.
