    Default Permit to carry

    Hello,

    A couple months after I turned 18 I plead guilty to a paraphernalia charge. Now 10 years later with no other convictions and having my childish fun behind me, I find I am not able to get a permit to carry. I am wondering if this is a punishment I will have to endure for the remainder of my lifetime? Is there anything I can do to legally carry a handgun?

    First off, IANAL...

    On to an answer, though: You can retain an attorney and petition to have the charge expunged from your record, provided that you have a clean history since then.

    It's not guaranteed, however if you have a clean history other then that one charge, it's likely that you can have it expunged.

    It's my understanding (you should double-check this with a lawyer) that drug related convictions are a permanent bar from obtaining a PA LTCF. The only recourse you have would be to attempt to get your record expunged.

    On what issue are you being denied? Are you a user or addicted to marijuana? No. Was your conviction/guilty plea punishable by one year or more?

    thats easy, just become a criminal... they dont need any permits to carry... no seriously, i think there was a thread about this situation a few weeks ago. try a google search. if that doesnt work im sure someone will be along soon to help you out..

    Thanks for the responses. they didn't give a reason why they denied me, the paraphernalia charge is the only one I have, so I assume thats the reason. I guess under PA controlled substance act, paraphernalia is included. Its kind of disheartening to hear this, but thanks for all the quick replies.

    No, I'm not addicted, nor do I use any drug. I dont even take aspirin for headaches. The max penalty for the conviction was for 6 months.

    i thought it was supposed to be a conviction of one year or more?

    It is ridiculous, but any drug related conviction, including yours, makes you ineligible. As others have stated having your record expunged is your only hope, and I recommend you try. Hire a lawyer and get this behind you.

    I don't have the laws in front of me and I'm sure if I'm wrong I will be corrected (you know who you are ) .
    For an LTCF any conviction under the controlled substance act and it's all over.
