LTCF Denial, confused. Clean Record post 18, No Felonies EVER
Hi,
I did search and read but I am confused and everyone's situation seems different, thank you for your time...
My record is clean post 18, pre 18 I just have a misdemeanor for small possession of marijuana. Is this really tripping me up, I know someone that was approved that has a gun charge pre 18, anything pre 18 misdemeanor should be null, correct?
So I applied in Doylestown/Bucks County yesterday for LTCF in which they did a background check but denied it. They couldn't tell me why, does this make sense?!?!
I searched the database http://ujsportal.pacourts.us/DocketSheets/CP.aspx where there is nothing listed under my name for multiple counties.
What can I do at this point besides the Harrisburg appeal.
Update:
4/25/12 - Original in-person PICS application, instant deny.

6/29/12 - Received response for the actual reason of denial, looking to pursue any options further to obtain LTCF if possible:

You'll get a letter explaining why you were denied, wait for that to come in.

Like streaker said, have patience. They will tell you why, at that point you can appeal. I would recommend contacting an attorney that is familiar with LTCF appeals to assist once you find out the reason.

Any drug conviction will prohibit you from obtaining a ltcf.
Perhaps they are mistaken because you were a juvenile, but there have been numerous instances of others in your situation where a juvi. drug conviction triggered a denial…rightly or wrongly.
Your best bet is to talk to an attorney and see if you can get that record expunged or sealed or whatever the legal jargon is.
On the up side there is a reasonable chance you can get a non res FL license, and perhaps some others. If your drug conviction was a minor deal (not sure of the specifics), and was more than 3 years prior to application FL will issue.FUCK BIDEN

I fully the support the law and if says no LTCF for a convicted drug addict, well then, so be it. Further, going nuts over a LTCF denial triggers such intense negative emotions, perhaps it's best that the law stays the same and a denial is upheld.

Just because you were under 18 when charged doesn't mean they didn't charge you as an adult, and not all convictions disappear after you turn 18... I have a friend who pleaded guilty to unlicensed carry when he was 16, he is still a prohibited person. He is a totally different person these days, but that doesn't change the fact that he is prohibited...

Thank you all for the prompt responses. Lol, not literally going nuts. More-so worried that I won't get it with a strong anxious feeling that I am not being treated right if the system is not supposed to deny me from something that happened before the age of 18 that was not a felony.

You have to answer the questions as phrased, not with any additional terms and conditions. You can't just add "since age 18".
Further, there are prohibitors that explicitly apply to juveniles, but some of them are self-expiring. Depends on the facts of your situation.Attorney Phil Kline, AKA gunlawyer001@gmail.com
