Lets face it..
If the shit does hit the fan in such a dramatic, large scale event.. It won't be the supreme court, or state goverements, that will ultimately decide what happens.
It's the Miltary and the Police forces. If they say they won't follow illegal orders, great.. But if Martial law is declared, and they start rolling APC's..
Well, thats another whole direction completely.

Ok, now that was fucking funny! And I do use that phrase -- but only since I moved up North, and only for the amusement value.
And the Constitution, as a simple matter of reality and practice, is not inviolable. While a lot of folks are pointing to Lincoln (and the suspension of HC, among other things), I'd like to remind you of what happened in Worcester v. Georgia. Basically, the Supreme Court reached a decision, and the executive branch refused to enforce it. President Jackson is widely believe to have said "John Marshall has made his decision; now let him enforce it!" The quote is probably nonsense -- but the principle is absolutely correct: the Constitution was violated by the government's refusal to enforce a decision of its highest court. And nobody gave a damn -- because the decision reached by the Marshall court was unpopular.
And it's gone the other way, too -- hundreds if not thousands of times -- with the Court ignoring the plain language of the Constitution to reach a desired political result.
I know it's depressing, but I realized a long time ago that the law (and the opinion of every judge) isn't about what's explicit or actually right -- it's about the result that the judge and the politicians want to be reached. They've got the guns -- there's nothing you can do but vote and hope.
Pick a result, and craft your opinion to reach it. Every judge does it every day, in every case.
