    Default very very long story short

    lancaster city police have my kel tec p3at had it since march of 2011. i loaned it(legal) to a friend and he "lost" it. it was found in a dead guys hand(tried to defend himself in his home with it, but was killed) what do i have to do to get it back?
    sig sauer p239 .357 sig DC(open carry for now)
    witness .40s&w
    .22mag/lr revolver
    .22 remington rifle semiauto
    12 ga moss 500 pistol grip(loaded with slug hollow points)[SIGPIC][/SIGPIC]

    I am not a lawyer but it sounds like a bizarre set of circumstances only a lawyer could help you with. I may be wrong but it does not sound like they are going to give it back to you without an attorney fighting on your side.

    The obvious thing here is your firearm is primary evidence in an investigation involving a serious crime. I wish you the best of luck in regaining possession.

    By the way how did your friend lose it?

    How did you find out the Lanc police had it? Did they call you? Had you reported it lost to them at the time your friend realized it was missing?

    Don't loan handguns to careless people.

    The chance that the police would return the gun are close to zero. The chance that a court would order them to return it are possibly less. And the cost of legal assistance would far exceed the value of the gun. (Hell, the cost of filing the petition with the clerk approaches the wholesale value of a used KelTec.)

    Gun people would be doubtful of this tale, at least parts of it, and we're biased to be sympathetic. A judge would flat-out disbelieve you.

    Yes, your friend owes you the value of the gun, because he was careless with it while he was responsible for it, whether it was a bailment or a loan or whatever. I suspect that the person who "found" the gun was not a stranger to your friend, and I suspect that your friend would have been more careful with a gun that was papered to him.

    BTW, this is sort of why we like to have bills of sale when we sell long guns. Because the police will ALWAYS be very interested in the last person it can be traced to.

    When you have cable, you miss good shows.
    When you miss good shows, you get upset.
    When you get upset, you make poor judgement calls.
    When you make poor judgement calls, you lend guns to the wrong person.
    When you lend guns to the wrong person, they get "lost".
    And when they get lost, they end up being found in the hands of dead people, and get confiscated by the police.
    Don't let your guns end up in the hands of dead people and get confiscated by the police.
