Neighbors dog trespassing, need advice
I need some advice on what to do, we purchased our current home in late 2009 and since then we have continuously had problems with our irresponsible neighbor letting there dog trespass on our property, we have heard there apologies 20+ times.
We have spoken to the husband and wife about this ordeal on many occasions and given them many times to mend this problem.
The dog consistently gets loose and runs over to our property, barks at us and our dog in a aggressive manner. So my question is can I defend myself and my family without getting into any trouble?Last edited by 600hpz31; May 4th, 2012 at 07:55 PM. Reason: typo

Contact your local PD, they'll either come out and speak to the owners or shoot the dog themselves.

If the dog is posing a real threat? No
Is the dog that aggressive or more of a nuisance?
If you live in town or similar where there is a discharge ordinance I would think it would have to be a serious life threatening situation.
Regardless, it may be best just to call animal control and have the beast carted away.
After the dog begins costing your neighbors some money they may be more careful.FUCK BIDEN

Very sound advice God's Country thank you. I would say more of a nuisance, and I am not sure about the discharge ordinance here, and I agree with you about the dog costing them $$, will change the whole ball game.

No dog, whether licensed or unlicensed, muzzled or not muzzled, shall be allowed to run at large in any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or on any public property whatsoever, or on any private property without the permission of the owner of said property. It shall be unlawful and an infraction hereunder for any owner of a dog hereinabove defined to permit a dog, whether licensed or unlicensed, to be at large within the Borough, unless effectively restrained in the immediate custody and control of the owner or custodian of the dog by a chain or leash not exceeding eight feet in length affixed to the collar or harness of the dog.Use restrictions.
No person shall, except in necessary defense of person or property, fire or discharge any gun or other firearm or any air rifle within the Borough of Lehighton. This restriction shall not apply to police officers using their weapons in the line of duty.Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof before any District Justice, be subject to a fine of not more than $600. and costs of prosecution and, in default of payment of such fine and costs, to imprisonment in the county jail for not more than 30 days.

you gotta admit it is not the dogs fault. the owners are the ones that need trained. imo i would call the leo,s every time the dog trespasses. after the owners deal with law a few times and they are inconvenienced maybe they will be trained to control the dog. worst case scenario bait him and turn him over to spca.
