I need a gun rights attorney in Philly
Long story short....
Several years ago, a girl I broke up with (for being insane) accused me of attacking her in order to get back at me. Even though she's a convicted felon (for burglarizing a previous ex-boyfriend's house), she was taken at her word and I was arrested and my gun seized by the Philly PD. All charges were dropped, vacated, dismissed, even the protection from abuse order was thrown out, all before even having to go to trial. (Wish they would have figured out that she was a liar before locking me up for a couple days, instead of after).
Anyway, I've been trying to get my gun back ever since. It took 2 years, and help from a state Senator's office to even get to the point where they reviewed my case to determine if they would return it to me. The investigating officer called me, told me he was recommending it be returned as the charges against me were harassment on the part of my accuser. But...he then told me that my request will be denied anyway because the policy of the Philly PD is to never return a gun in their custody unless ordered to by the court.
Well, got the denial letter and now my only option is to go to court. Can anyone recommend an attorney? It's cheaper to just buy a new gun, which I have since done, but it's the principle at this point. I'm not willing to let the PD steal my property because it's their policy.

If you fight it, setup a blog and a legal fund. I'll donate what I can.

Re: I need a gun rights attorney in Philly
Hey Kev,
My attorney (who doesn't handle this kind of stuff) recommended that you speak to a guy named John Mirowitz.
I believe this is his contact information:
John Mirowitz. ESQ
161 East Duncannon Ave
Philadelphia, PA. 19120
Tel # 215-324-0603 or 215-324-8221
Fax # 215-457-6304
He says this guy should be able to help you out but as always with lawyers have your checkbook ready. My lawyer estimates that something like this could easily cost over $1k when all is said and done.
He also wanted me to mention that in many cases with administrative denials there is a time limit on how long you have to appeal them. He mentioned it may be as little as 20 days so get things started ASAP.
Good luck with everything and please keep us up to date, there is nothing more I would like to see than someone winning a gun lawsuit against the city and the PD.Dan P, Founder & President, Pennsylvania Firearm Owners Association

I don't know this attorney personally, he is a former ATF agent, which is why I thought maybe he could help.

Re: I need a gun rights attorney in Philly
someone has got to do something about the philly PD. they think they can just make up their own rules.
i'd like to see someone press charges against them for theft in case like this. maybe contact the state AG office about having charges pressed against the Philly PD.

you could always try contacting the press, they are notoriously anti gun...but this month they are also more anti cop than usual, so you may have some luck...at any rate its free.

What does the denial letter actually say?

I imagine it says something like..
"We pwn *** n00b.
All your base are belong to us.
LMAOROFLZ!
NOW BOW DOWN AND OBEY!
Kindly,
Philadelphia Police Department"
All jokes aside, I really wish you win this fight. A good friend of mine had the same thing happen with his b%&$# ex-girlfriend, except there was no gun involved. He not only spent a few days in jail, but he got kicked out of college for it too. All charges were dropped, but his life changed drastically.==============
“If ye love wealth better than liberty, the tranquillity of servitude than the animating contest of freedom, — go from us in peace. We ask not your counsels or arms. Crouch down and lick the hands which feed you. May your chains sit lightly upon you, and may posterity forget that ye were our countrymen!”
~Samuel Adams

Re: I need a gun rights attorney in Philly
I would honestly just try to fight it myself without an attorney, if possible.
My guess is that you can do the leg work yourself, all you need is a hearing, it should be an easy win.
You'll save some money, you'll learn a lot about the process and law.
You'll be able to tell us how to do it when it is our time.
Either way good luck and at least do something, don't let it rest.
