    Our Government Knew NIU Gunman Was A Whack-Job Who Lied On Five Gun Applications


    Steven Kazmierczak’s My Space photo seen here displays abundant tattoos on both arms.

    The NIU gunman was well known by government authorities. He was confined to a Chicago mental institution after refusing to take anti-psychotic medicine was unruly and engaged in strange behavior such as cutting himself. He later joined the Army but was tossed out after basic training for psychiatric reasons. The gunman was off his required medication and his rocker for two years prior to the shooting.

    In order to buy the four firearms in Illinois, Steven Kazmierczak had to lie on five separate #4473 Firearm Transaction Forms, his Illinois Firearms Owners Identification Application. That FOID process takes months to complete. Once the FIOD was received Kazmierczak could not take delivery until he had endured the mandated waiting periods for the guns he had already purchased.

    At the point of purchase and well before delivery of the firearm both the state and federal governments have a part in conducting another background investigation to determine if there were disqualifying factors that would prevent the transaction. Since there were four purchases the process was repeated four times and government still approved the applications. You can see what paperwork this killer had to fill out and knowingly make false ststement on below:

    The system failed, if the laws on the Books were adhered to he would not have bought a gun legally.

    This isn't correct. The federal law, and any records pertaining to it, only deal with persons who have been adjudicated by a court or other lawful authority as "mentally defective" pursuant to some sort of hearing or who have been involuntarily confined as a danger to self or others by a court or other lawful authority after a hearing. It sounds like this guy was sent to wherever he went by his parents, which counts more as a voluntary commitment. There would have been no federal bar and no record.

    If he was over the age of 18 then a confinement against his will even if by his parents would require a ruling from the courts. As far as the Army discharge goes it may be that they did a "other than honorable" discharge instead of a dishonorable discharge as I believe that bars the ownership of firearms. Also are we sure the new NICS laws are in effect yet??? But nonetheless the gov't can pat themselves on the back for doing a great job passing flacid, impotent laws which do absolutely nothing to stop those who wish to do harm!

    Exactly. We don't know that for sure. The media reports indicate that he was placed there by his parents, allegedly because he was "unruly" and was a cutter. Nothing about it being against his will, or about any ruling from the court. They may have suggested it for his own good, or threatened to cut him off if he didn't go.

    It's actually a fairly involved process. It typically requires testimony from mental health professionals. The prospective patient has the right to counsel, to present evidence, and to appeal. Suffice it to say, it leaves records.

    As to the category of discharge, no an "other than honorable" discharge by itself does not bar one from possessing firearms. A dishonorable or a BCD does in most states, but those only are awarded following a court martial (special or general court martial for a BCD, general for a dishonorable), which makes them more or less equivalent to a felony conviction. Again, a fairly involved process that involves significant documentation.

    Wow Illinois doesn't ask if you were dishonorably discharged from the armed forces? Even PA asks that..
