    Default Questions about selling in PA?

    Hi All,

    New in PA, came up from Orlando and when I was there we had a site just like this and it also had a classified. I had sold to private citizens several times and all Florida required is that it was sold to a resident only, of course a receipt just to protect the seller?

    Is this the same in this state or am I better off selling to a gun dealer??

    Same, except get a dealer to transfer the handgun registration.

    FTF (face to face) sales require no paperwork or background check done for long arms (rifle, shotgun). Handguns must go through a FFL or Sheriffs Dept, but not too many sheriffs will do it, they typically send you to a FFL. Any handgun sale requires the buyer to undergo a background check.

    In fact you can ship a long arm (no handguns) directly to another person within PA.

    A bill of sale with name, address, phone, ID is always advisable.

    Ok so how does it usually go? I expect you go the a gun shop with buyer and gun to transfer. Buyer pays fees and fills out paperwork for background check? and then does the gun get left at the shop or do I keep it until background check clears??

    instant check in pa. You should clear and be done with it before the ink dries.
    At the shop where I deal they are calling it in while I do the 4473. In the case of a handgun there is an extra form for the state "sales record". please note they cannot keep a firearms registry. it's against the law. That said, our supreme court has ruled that the PSP Sales Record system is not a registry.

    No wait required.

    What rwilson said, everything is done right there in the shop. If buyer passes the check, he pays you, FFL finishes his paperwork and you walk out. If he does not pass the check, buyer has 2 options. 1. Appeal the denial, wait for that formality to finish, buy gun if denial is reversed. 2. Doesn't appeal the denial/looses the appeal, no sale.

    There is also the possibility that the buyer could be put on a hold to give the PSP time to check something that is not quite right (name, DL#, etc. close to a denied person). Then the sale is on hold until he either passes or is denied then see above.

    one thing I didn't mention. during this transaction I think the FFL runs both parties thru PICS. but I'm not sure. I do know that in one instance two guys came into his shop wanting to transfer a pistol. it turned out both of them were prohibited persons. the cops went to their homes to make arrests.

    The FFL does not run a PICS on the seller, only on the buyer. IIRC (but I don't have the PICS info book in front of me) the FFL cannot initiate a PICS on someone that is not purchasing a gun. PICS is only to be used for background checks on persons purchasing a gun from a FFL. No PICS is required for a private sale of a long arm.

    It would be unlawful for an FFL to run PICS on the seller.
