Where my Gun Rights Mistakenly Taken Away
I was convicted of two Misdemeanor Drub Charges in 1995 in the state of Pennslyvania. I was denied the right to purchase a gun in California last week due to the convictions in PA (The CA DOJ told me I had a hold on my record in PA but could not tell me what it was for only that my request came back as denied with the reason given as "Other". When I called the PA DOJ I was told it was due to those two convictions but the Clerk of Courts could not tell me if that was enough of a reason to have my rights denied or if it was a mistake).-
-Has anyone every heard of this type of thing?
-What do I need to do to get my rights restored?
-Can anyone recommend a gun rights attorney in Erie County?
-Thanks

If any of the drug charges were punishable by 1 yr in prison or more then you might have a very hard time. go through the appeal...I wish you luck

Re: Were my Gun Rights Mistakenly Taken Away
Thnaks for the feedback and support.
I don't beleive that either charge was punishable by even more than 30 days in county jail based on several things I have seen online regarding sentencing for marijuana in PA.
Have you ever heard of someone sucessfully petitioning to have their gun rights restored?
Thanks again.

Re: Were my Gun Rights Mistakenly Taken Away
Plenty of people have had their gun rights restored, under a variety of circumstances, all of them different. But I think IIRC, drug related issues are one of the most difficult to overcome. Im confident there are several threads on the forum related to your question, as it comes up fairly often. I would start with a forum search for those threads and then read all you can and THEN ask specific questions. That being said, every individuals circumstances are different and its going to be difficult ( not impossible) to find a case with the exact same set of circumstances as yours for comparison.
Phil Kline ( GunLawyer001) on this forum is a VERY highly regarded and knowledgeable PA Attorney that specializes in firearms law and related matters such as expungements and pardons, one (if not both ) Im confident you will need in order to get your rights restored.Si vis pacem, para bellum

Re: Where my Gun Rights Mistakenly Taken Away
I don't believe it’s all that likely that your rights were mistakenly taken away.
It does happen, but without the specific charges that you were convicted of we’re all just guessing.FUCK BIDEN

Then you add this and it puts it where you don't want it to go...
