    Default LTCF issue?

    This is a strange encounter with leo. My friend who has a ltcf ran out of gas on RT. 30 last night. He left his passenger in the car while he went for gas. While he was gone 15 min, a local leo came behind the car and put his lights on. The passenger told the leo that the driver went for fuel. The leo asked the passanger for id and went around the car and saw a handgun box in the rear seat. The passenger told the leo that his friend has a permit and that he thought there may be a hand gun in the car. The leo then removed him from the car and had another leo look in the center consel were he found a loaded hand gun. He said he was going to charge the passenger with possession of a firearm with no permit. Fortunetly, the second leo new the owner of the car, and when he returned he showed his permit and they left it alone. This does raise the question, that if you have a firearm in your auto and just run into the store, are you leaving your passengers at risk of charges.

    Yes, even if it's your car and your own wife. If she has no permit, and you leave her alone in the car with the gun...she is in trouble.

    I almost left a Glock in my wifes' car once, but I remembered just before she pulled out of the driveway. She now has a permit which makes it much easier.

    There is a protective clause for spouses and children for that.. However, other persons may be in trouble.


    §6106. Firearms not to be carried without a license.

    (b) Exceptions.-The provisions of subsection (a) shall not apply to:

    (13) Any person who is otherwise eligible to possess a firearm under this chapter and who is operating a motor vehicle which is registered in the person's name or the name of a spouse or parent and which contains a firearm for which a valid license has been issued pursuant to section 6109 to the spouse or parent owning the firearm.

    No, the officer was mistaken. The passenger is not able to be charged with the possession. See beow.

    Not correct.
    One of the exceptions to §6106. "Firearms not to be carried without a license."
    is:
    (13) Any person who is otherwise eligible to possess a
    firearm under this chapter and who is operating a motor
    vehicle which is registered in the person's name or the name
    of a spouse or parent and which contains a firearm for which
    a valid license has been issued pursuant to section 6109 to
    the spouse or parent owning the firearm.

    Hmm... yeah.. I must have miss read that to extend to other persons. I got the wife and children part right though.

    Makes loop holes for criminals to get out of things they should go to jail for, and makes wiggle room for the judges to find things in the laws, to throw honest people in jail for violating them.

    Is that for a handgun or a LOADED handgun...or dosent it matter?

    If my wife was allowed to leave with a LOADED handgun in the car and she had no permit...I ran outside like a madman for no reason.

    Yeah, loaded/unloaded makes no difference. It's one of the listed exceptions to carrying on or about ones person or in a vehicle. The "unloaded" is another exception entirely.

    As for the acting like a madman, I spoke with your neighbors and they said they're used to it.
