    Default Court OKs challenging post office gun ban

    A concealed carry couple from Colorado gets OK to file lawsuit... Thought it relevant to post here, since this is a fed issue which should affect all states.

    It's a federal building no?

    If that argument stands, then why couldn't it be used for carry in all government buildings?

    Baby steps I guess. I for one am hoping this is successful and that it does balloon to all government buildings.

    Depends (and we have had this discussion before). If the property is ONLY property used by the post office then no you can not carry onto that property. However if the PO is in something like a strip mall then the parking lot is, shall we say 'community property'.

    We have one of each up here, the one here in town is a post office on a piece of property, the other is in a small strip mall. The first I don't carry onto the second I do (just not into the PO).

    In my case it is a shared parking lot. Kinda like a strip mall. There are some parking spots marked (Post Office Only), I guess so people don't hog all the spots when shopping.

    That makes no sense, as you can carry in a courthouse parking lot. What gives?

    the "federal building" statute 18 USC 930 doesn't apply to Post offices. Federal Regulation 39 CFR 232.1. does....and it states "applies to all real property under
    the charge and control of the Postal Service" which would include a dedicated parking lot.

    why not???? If you're presuming abrogation of 930 via 39 USC 410, I'm unaware of that ever being successfully adjudicated and, IMO, would be a very weak case.

    It will only effect all states if it goes to the Supreme Court. Until then it only effects the US District and the states of that district.
