    Default Gun Buyback - Phoenixville this Saturday

    PHOENIXVILLE — Aimed at ridding the borough of unused firearms in an effort to make the streets and homes a little safer, the Phoenixville Mayor’s Office and community organizations are holding a gun buy-back program Saturday in hopes it will prevent weapons from falling into the wrong hands.

    Phoenixville Mayor Leo J. Scoda decided to collaborate with the Phoenixville Community Health Foundation, Phoenixville Police Department, Crime Victims’ Center of Chester County Inc. and more to give the community an opportunity to turn in unwanted and unused weapons.

    The event — held from 10 a.m. to 2 p.m. Saturday at Phoenixville Borough Hall, located at 140 Church St. —is a no questions asked affair, where people can turn in complete guns for $50 gift certificates to local merchants, including Kmart.

    I'm working Saturday, otherwise I'd be all about trying to make counter offers.

    I'm still questioning the legality of these events. Unless there's an FFL there, how can they legally be purchasing handguns and doing the proper paperwork? Isn't the city committing a crime buy purchasing these without proper paperwork?

    Streaker69 I agree with what you said. If there isn't a person there with an FFL then they are certainly breaking the law. I think someone should go there and challenge them on this. If they don't have anyone with an FFL then I say call the ATF and file a report.

    It isn't just a matter of having an FFL there. They article says "no questions asked", even with an FFL they would be required to fill out the transfer paperwork from the person selling the firearm.

    There is no way this is legal per the UFA, is it?

    When police departments purchase firearms from their local gunshops, they're still required to do the paperwork, right? They're not exempt from it, correct?

    A seller or transferror who is not a licensed importer, manufacturer, or dealer is not required by any law to fill out any "transfer paperwork". The receiver (the police department, in this case), as the transferee, is the party who is required to fill out the 4473 and pass the applicable background check.

    There is no exemption in 18 PA C.S. § 6111 et seq (relating to the sale or transfer of firearms) that allows police departments to receive handguns without a federally-licensed dealer or chief law enforcement officer (i.e., county sheriff or Philadelphia chief of police).
