How to purchase a gun in Pa.

I live in NY city and own a vacation home in Pike County. I'd like to purchase a 22 rifle. It will remain at my vacation home at all times. Do I need a Pa. drivers license to purchase this gun? Someone I know told me I need one to purchase a handgun but not a long gun. Is this true?

Yes you need to be a PA resident to purchase a Handgun in PA.

If you live in New York you need a NYC long Gun License to Purchase a long Gun.

According to Federal regulations you are a PA resident for Federal Firearms law purposes while you occupy your owned Pa vacation home (27 CFR 478.11).

During those periods of occupancy you can legally purchase a firearm (longarm or handgun) from a Pa FFL although some dealers may not want to sell it with your NY DL.

You can also purchase a longarm from another Pa resident in a private sale. Whether that seller would want to see your DL or would accept your NY DL is totally up to them but your purchase is legal (assuming your not prohibited, under age, or otherwise disqualified under law).

27 CFR 478.11
State of residence. The State in which an individual resides. An
individual resides in a State if he or she is present in a State with
the intention of making a home in that State. If an individual is on
active duty as a member of the Armed Forces, the individual's State of
residence is the State in which his or her permanent duty station is
located. An alien who is legally in the United States shall be
considered to be a resident of a State only if the alien is residing in
the State and has resided in the State for a period of at least 90 days
prior to the date of sale or delivery of a firearm. The following are
examples that illustrate this definition:

Example 1. A maintains a home in State X. A travels to State Y on a
hunting, fishing, business, or other type of trip. A does not become a
resident of State Y by reason of such trip.
Example 2. A is a U.S. citizen and maintains a home in State X and a
home in State Y. A resides in State X except for weekends or the summer
months of the year and in State Y for the weekends or the summer months
of the year. During the time that A actually resides in State X, A is a
resident of State X, and during the time that A actually resides in
State Y, A is a resident of State Y.

Any firearms purchased should remain at your Pa residence.

Anyone can buy a longarm at an out-of-state FFL (private sales not allowed). The issue is that the FFL must assure that the sale complies with the purchaser's state/local laws.

If the OP is considered a NYC resident the there is a lot more involved regarding licensure then if the OP is considered to be a PA resident.

For example - yes, you bought rifles in Pa from an FFL as an NJ resident but you had to display your NJFID card and the NJ directed paperwork had to be executed same as if you went to an NJ FFL.

Based on my previous post, the OP is considered a Pa resident for Federal firearm law purposes and can buy a longarm or handgun at a PA FFL during his periods of occupancy of his vacation home. His only issue is finding a Pa FFL that will agree to consumate this legal transfer.

What is a PICS?

PICS = Pa Instant Check System. It is also linked with NICS (National Instant Check System). It is a background check to see if you have a firearm possession disqualifying criminal or other prohibiting record.

The use of NICS is required by Federal law for all firearm transfers through an FFL and PICS is superimposed by Pa statutes for all FFL transfers, sheriff transfers and LTCF application investigations in Pa.

If your Job is in New York you can always commute. THousands of People from Monroe, Pike, Luzerne, Carbon , Montgomery North Hampton county do it.

Your kids will love you for it. One of my Neighbors up the hill is from the Bronx, they have a vacation/weekend home here and the kids literally cries when its time to back to the Bronx, Here they can ride their ATV's ,shoot their .22's in their back yard, go swim in the streams, catch craw daddies and eat them and no body gives a shit. You can tell when your neighbors bought a new gun- gunshots heard all day saturday- boy i love this place call Pennsylvania, no offense but get out of that Jungle
