    Default Must Philadelphia LTCF references be Pennsylvania residents?

    Philadelphia requires two references. The identifying information for the person providing the reference asks for his "PA Drivers License #". There is no provision on the form for a driver's license from another state. But neither does it state anywhere I can find that the reference provider must be a Pennsylvania resident. Anybody have any experience with this?

    Philly makes their own friggin' rules, not in line with the PA statutes.

    The only requirement on the official LTCF application is that references not be family members...no mention of them being required to live in Philly, PA or even the USA.

    No, they don't need to be from your county or state. Technically, they probably could be from Russia if you want.

    Unfortunately...yes.

    NOTE: Failure to provide (2) references (NOT FAMILY MEMBERS), as required on your
    application, will result in your application being denied, and forfeiture of your application fee. Enclosed
    are two references information sheets that your references may use for their convenience. References
    should include name, address, date of birth and PA State ID or drivers license number at the top of the form.

    18 Pa.C.S. §6120 prohibits municipalities from regulating possession of firearms in any manner not consistent with state laws. This would include imposing requirements on LTCF applicants, when those requirements are not consistent with state law.

    State law makes no requirement on where one's references reside. As a matter of fact, statute doesn't even require references, but that's a different topic altogether.

    I know what state law says...

    The man asked if they needed to be PA residents...I said yes....he didnt ask if it was legal or not.

    Well on this forum, we should discuss what is current law. If a county or city passes an illegal law or policy, we call it out as invalid.

    What Philly is doing is not in line with state law which pre-empts below it.

    No they don't have to be PA residents. Someone reading your post would get incorrect info

    Are you people that dense?

    Yes let them not fill out those illegal reference forms or not have PA residents fill them out.

    Lets see how that works for someone applying for a LTCF in Philly.

    Im sure the OP would be happy to take the city to court and challenge their illegal ways.
