Section 6107 and Declared States of Emergency
As we all know by now, our good friend Irene is schedule to pay us a visit this weekend. If it really is as ugly as they're predicting, I expect we'll see a declared state of emergency. With that declaration, Section 6107 comes into effect. For reference, here's that section:

My question concerns 6107(a) and, specifically, (1) and (2). Are these to be read as "both (1) and (2)" or "either (1) or (2)"? In other words, is an LTCF alone sufficient to carry during a state of emergency, or must you also be "actively engaged" in defending yourself? There are places in various laws where "or" is specified, as is "and", so it's not clear to me which applies where it's not specified.

I read any enumerated list without specific connectors as disjointed ("OR").
For example 6106(b) has a list of 16 ways you are exempt from needing a license without any connectors.IANAL

Just from reading it as written, I would assume, it would be meant as a a condition, not "actively engaged in defense AND a LTCF holder"

It is "or" without a connecting "and" as tl_3237 mentioned.

unless
that person is:
(1) Actively engaged in a defense of that person's life
or property from peril or threat.
I have 4 small Special Needs children under our roof - this clause is ALWAYS in effect - 24/7/365 at my residence. Nefarious sorts may test that defense at their earliest convenience.
I don't like the sound of that "Class III!"
