Out of state gun transfer
I am picking up a pistol in Tennesee where they do not have person to person gun transfer laws. What would I need to do in order to properly transfer it into my name??

to do it legally it needs to be sent to an ffl in pennsylvania who will transfer it to you.

In order to be in compliance with federal law, you cannot pick it up in TN. It must be shipped to a dealer in your home state, where the necessary paperwork/background check will be completed before you take possession.

All interstate handgun sales/transfers must go through an FFL in your state of residence, with state of residency defined as where you actually live at the time of the transfer. So if you live year round in PA, you must have the gun shipped to a PA FFL. If you live part time in TN (e.g., college student or vacation home), then for the period of time that you actually live in TN (and can prove it to an FFL with supporting documentation), then you can do the transfer at an FFL in TN. (See here for the appropriate ATF citation.)
Also, what is the background on the transfer? Is it just a purchase from a friend/family member, or is it being inherited? If it's inherited, as a direct bequest through a will, then there is no need for a transfer at all. Otherwise, a transfer will have to occur.Last edited by y0rlik; August 4th, 2011 at 06:41 PM.
