    Red face Taking Guns to West Virginia

    I apologize for wasting bandwidth with this question but better safe than sorry. I'm going to West Virginia and want to do some shooting at my Aunt's house in the woods. I don't have a LTCF and will be going through Maryland with an AR-15 with a 30 round magazine and a Remington 870 with a 6+1 capacity. Both guns will be in the trunk in cases with my ammo in the back seat, are there any laws I will be violating? Thanks in advance

    Perfectly legal.

    Possession of those guns are legal in WV, so you are covered under FOPA for transporting through MD.

    Okay thanks a ton, my biggest concern was the 30 round mag in Maryland.

    I'll tell my Dad, I don't drive, hell in 3 years I may be able to say I got my LTCF before my Driver's License.

    I thought FOPA was a little 'grey' on accessories being transported? Doesn't it only pertain to firearms? I swear this was just brought up on another thread on here.

    Magazines with capacity of greater than 10 rounds are only illegal to sell or buy in MD. You can own them, whether you are passing through or reside in the state. (For ex: MD residents can go outside the state, buy a 30 round mag and bring it back into the state.) So you're ok on that.

    Weapons need to be unloaded, and ammo must be stored in a separate container from the weapons. So rifles in cases in trunk, ammo back seat should be fine.

    Caveat: I think a loaded magazine is considered a loaded gun, so magazines need to be unloaded as well, but not 100% on that. If that's correct, transport the mags with the guns in the trunk. Don't transport mags with the ammo. Don't have any mags loaded.

    I don't think it's 'grey' at all. IMO, FOPA applies to firearms, period. If a 30-round mag is not legal in MD (I don't know if it is or not), then possessing it even while passing through would be a crime, as magazines are not protected under FOPA.

    Passing through without getting caught doesn't mean what you did was legal. I'd suggest the OP either clarify this issue before traveling, or leave the "high-capacity" magazines behind.
