    Default Justifiable Homicide by a LTCF Holder

    This from The Philadelphia Daily News from 04/04/2011. It appeared in the news briefs on about page 9. So it was easy to miss. As I have stated before the liberal media will report on page 1 when a criminal commits a crime with a gun, but when a gun is used legally by a LTCF holder to save lives as this person did, it's in the news briefs because the liberal media hates the 2nd Amendment and guns in general. Here's the brief:

    Justifiable homicide

    Investigators have determined that a shooting death early Saturday in West Oak Lane was justifiable homicide, police said. Shortly after 5 a.m. police found Robert Daughtry, 27, lying on Pittville Avenue near 18th Street with a chest wound. He died at Albert Einstein Medical Center, police said.

    His shooter, who was not identified, had a license to carry a concealed weapon, police said. Daughtry, of 74th Avenue near Andrews, had been shooting up a house on the block and the man who shot Daughtry did so because he believed the residents of the house were in danger, police said.

    I also did a little research on the dead perpetrator. From the Philadelphia Court website. It seems Mr. Daughtry was a career criminal with a long criminal history for possessing drugs and at the time of this justifiable shooting he was on probation for a drug conviction back in September 2010. Also according to the court website he was also arrested more than once for carrying firearms without a license. He was on probation, and thus prohibited from even touching a gun. Yet he had one, illegally. Like I said the liberal media didn't do any research on the perpetrator. I found his criminal record in about 2 minutes. That's what I call great investigative reporting by the liberal Daily News. I'll bet he never went to apply for a LTCF. Or subjected himself to the PICS check at the gun shop.

    They should have reported something like this:

    The perpetrator Robert Daughtry, had an extensive criminal record, including a conviction for drug possession, for which is was on probation for at the time of this incident. For that, under state and federal law he was prohibited for possessing a firearm. And he also had several arrests in the past for carry firearms without a license. Also arrests for assault and attempted murder. This man was a career criminal for which the justice system in Philadelphia couldn't seem to keep him in prison, for he was a clear threat to society.

    Another winner.

    He has a Felony 3 conviction for 6106 from his arrest on 03/15/2002, so he was prohibited from possessing firearms entirely (regardless of probation status).

    When he was arrested for firearms charged on 01/18/2004, he should have been also charged under 6105 as a person not to possess... But when they're just going to nolle pros the gun charges, why bother adding another one?

    Could they have written a more awkward sentence to describe his illegal and threatening actions that prompted the LTCF holder to shoot him?

    April 2, 2011

    A young man is dead following a domestic dispute in West Oak Lane Friday night. According to police, the trouble began when Robert Daughtry, 27, was involved with a fight with his girlfriend on the 7200 block of Pittville Street.

    At some point during the fight, Daughtry left the house, police say. He returned later with a gun and got into a fire fight with the brother of the woman he was fighting with, who also lived at the house.

    “He left the house and returned firing a weapon into the house,” said Sgt. Charles Coan of the homicide division. “The occupant of the house fired one shot at him and struck him in the chest.”

    Police transported Daughtry to Einstein Medical Center, where he was pronounced dead at 6:19 a.m. Saturday.

    Coan said no arrests have been made in the case, but the homicide division will transfer the case files to the District Attorney’s Office Monday for follow up

    Of course not. That would make shooting back sound reasonable.

    Shouldn't this be in News, since it's not connected to a legal/political question?

    Gun ownership is over rated... the brother should've just called 911 and waited for cops to arrive to save the day while the boyfriend emptied his gun into the front of the house.
