    Default Transfering gifted firearm.. will there be a problem?

    I want to transfer a firearm that a friend wants to buy that was gifted to me by my mother. She purchased it, went through the NICS check, then gifted it to me. I have the receipt of the sale and copies of it, as well as copies of my birth certificate to prove that she is my mother (she kept her maiden name). Will there be any problems, or delays? Should she be there as well?

    There is no registration of firearms to people in PA

    Forget all the specifics you posted and don't mention it.

    The gun is yours, and you would like to sell and transfer it to someone else.

    I'll admit, never heard of the scenario on the forum before.
    Curious if anyone adds anything to correct/validate what I posted

    PICS/NICS is run on people not guns, although they may run the serial to make sure it isn't stolen

    There wont be a problem.

    There wont be a delay unless the buyer has a spotty history or has a name/features similar to someone who does have a history. PICS does not know what kind of gun is being transferred, nor any details of a gun - it only deals with the buyer's criminal/mental history.

    Just don't mention things like homeless men and AIDS, dissolving bodies in acid, the end of the world, or your back injury. Seriously though, you should be fine.

    Good to know. Thanks! Although he was never charged or convicted with anything other than disorderly conduct (disturbance of the peace - charged only) when he was younger he has had some stuff in his past so I'm worried about that. He is eligible to own a firearm to our knowledge, but I hope there won't be any delay because of his past run ins with the law. I don't wanna have to leave the darn thing there til its approved but if thats what happens.. thats what happens.

    When you take the gun to your local gun dealer to do the transfer, several things will happen. The FFL will get the gun from you and enter it into his books as an acquisition from you; you will fill out the sellers info in the bottom of the PSP Form SP4-113 and sign it. Your friend will fill out the top part (and the BATFE Form 4473) and undergo the background check. The FFL will fill out everything else. If everything is good, then the FFL will show (in his bound book) the disposition of the gun to your friend. Your friend pays you and that's all you'll get involved in. It doesn't really matter how you got the gun (unless it's stolen, etc. ), you are the legal owner and you can do with it as you please. Your mother has no reason to be there, it is your gun, she gave it to you.

    Even if it were, there is no way to detect this during the transfer process.
