    2011 2nd Amendment Liberty in PA is Second to None rally & lobbying event.

    The 6th annual Second Amendment Liberty in PA is Second to None rally & interactive lobbying event is going to be on

    Tuesday May 10, 2011 rally kicks off at 10 am on the main steps outside of the capital
    this is NOT inside the Capitol building so dress appropriately for the weather.

    With the 2011 Pennsylvania Right To Keep and Bear Arms Rally quickly approaching we wanted to take a moment to highlight the most important part of the rally that we do each year: Legislator Education.

    Each year after the speaking engagements for the rally, gun owners from around the Commonwealth are organized into groups broken down by geographic region and assigned a team leader so that they may walk the halls of our capitol speaking to legislators about issues important to gun owners. This is one of, if not the, single most important thing gun owners can do to help preserve their rights!

    At the rally there will be “Group Leaders” broken down roughly by voting districts, so that gun owners can join a group that is likely to contain their representatives. Keep an eye out for these group leaders and pick a group to join!

    Please note that when picking a group to join, try to go for the one with the fewest amount of people. We want to make sure that the groups are split up as evenly as possible, if everyone runs to the first group in their list, this won’t work out so well.

    Once again, thank you to every gun owner who joins us in standing up for their rights and we can’t wait to see you there!

    Anyone with a handgun and a valid LTCF permit we have and will make provisions to have them safely stored by the capital police in the PO Office sized lock boxes or down stairs. All handguns will be secured.

    The PA Capitol Building Firearms check-in form is attached. I suggest you fill it out before arriving. Go in the entrance on the fountain side of the building and tell the Capitol police that that you have a firearm to check. They'll want the filled out form and your LTCF. They have several racks of PO Box sized lockers for locking up each one individually. In my recent experiences they have been courteous and efficient.

    Also since checking firearms is going to be a issue, EVERYONE please try to be patient and understand with capital police, most every officer that we have met really appreciate gun owners efforts at these lobbying event because when they take the badge off they are just like US and stupid gun control laws put them and their families at risk just like the rest of US.

    If someone has a problem with capital security get the officers name and badge number Immediately after clearing security come find one of the volunteer staff helping on this event then Kim Stolfer or me will deal with it that day with the Reps help it will be resolved. It will be handled promptly just don’t be a jerk about it, making a scene that makes all of US look bad.

    DON'T wait to come home and post it here, resolve your problem there, that day. If its un safe handling of firearms what ever, lets US know lets work together to get it fix with capital police that day.

    The capital police have a difficult job handling their assigned security task they don’t make the rules, the Reps do, they delegate authority to a position which they oversee. They are going to be overwhelmed with lots gun owners on May 10th, just put yourself in their shoes for a moment, they are people just like US and like I said most do appreciate of efforts to fight for our rights so give them some slack.

    We are looking for team leaders and gun owners willing to get more involved and learn what it takes to protect your Freedoms & Rights in HBG.

    WE are going to hold a western and eastern team leadership training program before the May 10, 2011 events detail to follow soon.

    We are going to be there on Monday May 9th doing some pre lobbying before the May 10th main event and making sure there is NO problems with securing all of your handguns that fall into sections with capital police for anyone with a valid LTCF permit.

    We are tentatively going to be there about 11 a.m. time frame, on May 9th. The event will last to at least 3 p.m. and maybe as late as 6pm. If you have to leave before that or you can’t be there that early or arrive late we will try to accommodate you the best we can using cell phones to coordinate.

    We will meet up just outside the security check point where you check your firearms. It’s the South entrance at the rear of the Capitol Building by the big water fountain off Commonwealth Ave.

    If you come in the main entrance (with all the steps) on North 3rd street, you can NOT check firearms here. If you don’t have a firearm you can come in that way and make your way through the building to Commonwealth Ave entrance.

    There are several nearby parking garages convenient to the capitol building beginning with the glass one off of N 2nd street off of Locust St. by the river. Another parking garage is off the intersection of Forster St &N 7th street by railroad tracks. There are also all kinds of parking meters & other places to park around the capital complex.

    What we also ask is that you dress in business casual attire with comfortable dress shoes as we will be walking all over the capital complex. The point is to make what we say and information we present the focus of what the Reps will remember not how we dress or looked. It is important to dress appropriately for these events so that we leave a positive impression. I am personally uncomfortable with ties and dress shoes, we all should do what is required for the larger goal. Always dress to impress and you can't go wrong.

    The mission of May 10th event is three parts

    1) rally phase - to listen invited guest speaker about the importance of protecting firearm rights.

    2) Interactive lobbying event - is to break up into smaller groups under a team leader guidance (looking at 20-25 teams for 253 reps) and directly express your feeling and views about firearm laws to ALL the elected Reps that we get a chance to catch in their offices between meetings or sessions..

    3) Have a good time and learn how you can protect your rights by being involved in the process

    The 6th Annual 2n d Amendment Rally date has been set for 10 AM on May 10, 2011 in Harrisburg, Pa. Once again we ask for your help and participation in this event. We will use this event as a springboard to pass vital pro gun legislation that will affect how FFL's conduct business and your 'right to bear arms' throughout the Commonwealth of Pennsylvania. It cannot be repeated often enough that the more interest shown at these kinds of events, the more our elected officials will notice our presence and the more impact our efforts will have throughout the day.

    Our past five rallies have highlighted needed changes in Pennsylvania Firearms laws resulting in
    improvements and protections being enacted into law such as 'prohibiting the confiscation of firearms in an emergency' and protecting the rights of hunters to carry a self defense firearm with them when in the field and eliminating the gun ban when riding a snowmobile and numerous other needed changes. With YOUR help we can begin to raise the awareness of other problems (political minefields) that exist and encourage changes that the 'people' want and deserve. After all being the 10th most restrictive state in the country on firearms (according to the Brady Campaign) certainly hasn't stopped criminals and cop killers has it?

    After the rally, team leaders will break the attendees up into groups and visit every State House member and State Senator in the State Capitol to ask for their support for bills such as HB 40 (Castle Doctrine), (Transportation of Firearms), (Penalties for Municipalities that enact local gun laws), and (PA Instant Check System Reform) plus several other bills. Everyone that pre-registers will be informed of the team (organized by county of residence) they are on ahead of time by e-mail. We need your help to pack the halls of the State Capitol Building to make this a successful event! After we visit all of the Legislators in teams, we suggest that you focus your attention on 'your' Senator and House member and let them know that he/she needs to listen to the needs of their constituents. The preferred dress is business casual. If you don't own a suit or sports coat, try to borrow one and dress appropriately. Our appearance is a key factor in credibility. Once you see how the team leaders present the issues to their Legislators, you may want to again pay a visit to your Senator or Legislator at their district offices at a later date to follow up on the issues discussed in Harrisburg.

    It is important to point out that each person attending will need to pre-register on the rally website
    (www.2ARally.com ) and be present if you want a chance to win the prize,
    . If you haven't pre-registered on the website, plan to show up a little earlier so that we don't experience a
    last minute rush. This gun can be seen at yvww.2Arally.com along with the downloadable event flyer, details of the event, maps to the Capital Building, plus some of the bills we deem to be important issues in the Commonwealth. Also included are some of the guest speakers invited. If you plan to arrive armed, try to be there by at least 9 AM to check in your firearm at the door (rear entrance of Capitol building by fountain).

    Title 18, section 913:

    (e) Facilities for checking firearms or other dangerous weapons.--Each county shall make available at or within the building containing a court facility by July 1, 2002, lockers or similar facilities at no charge or cost for the temporary checking of firearms by persons carrying firearms under section 6106(b) or 6109 or for the checking of other dangerous weapons that are not otherwise prohibited by law. Any individual checking a firearm, dangerous weapon or an item deemed to be a dangerous weapon at a court facility must be issued a receipt. Notice of the location of the facility shall be posted as required under subsection (d).

    Title 18, section 6106 (b)

    (11) Any person while carrying a firearm in any vehicle, which person possesses a valid and lawfully issued license for that firearm which has been issued under the laws of the United States or any other state.

    (15) Any person who possesses a valid and lawfully issued license or permit to carry a firearm which has been issued under the laws of another state, regardless of whether a reciprocity agreement exists between the Commonwealth and the state under section 6109(k), provided:

    (i) The state provides a reciprocal privilege for individuals licensed to carry firearms under section 6109.

    (ii) The Attorney General has determined that the firearm laws of the state are similar to the firearm laws of this Commonwealth.

    The section above is the area of law that is being used to deny people the ability to enter the Capitol building with firearms because of the PA Supreme Court hearing rooms upstairs. The section below is the one referenced in Section 913 and as you can see ‘carry’ is defined as those who have a valid and lawfully issued license. Perhaps it is not obvious but this does preclude LONG GUNS!

    ANY item prohibited because of security concerns (but otherwise legal to own) must be stored per statute, not just "handguns." Also, there is no legal requirement to possess a LTCF, or even be licensed to make use of the storage facilities required by law. The same goes for providing a DL# and/or serial number of any firearm one wishes to store (both requested by the Capitol Police).

    Neither the Capitol Police nor the organizers of any event held at the Capitol should be promoting any concessions beyond what the law actually requires (or doesn't require).

    gnbrotz, not that I don't disagree in principal with many of your points you raise, they have done whatever they like with our money, Freedoms, Rights even twisting the letter, spirt and intent in laws to mean whatever they say it says, all of that we allowed taken by our silent consent. that said..........

    To gnbrotz and anyone else

    There are traps built into PA law (see below). While one appears to condone and permit and even compel certain actions (like Section 913) other sections open up liabilities under the law to prosecution as in section 908 and 6106.1 among others as you know and can see below.

    So my suggestion is for gnbrotz or anyone else to communicate this to the Capitol police, especially after the Tucson shooting, and see what they say. Take a day OFF, make an appointment with head of the Capitol police to make your points and address your concerns. Then you should take this to your OWN House and Senator to change the procedures. As a matter of fact, since this same subject was brought up last year before the rally by a select few people.

    Got to ask a serious question as to what anyone of them has done thus far to change things is certainly in order since people wants to hijack our rally for their pet theories, don’t you?!

    Really why not? Why are they letting this policy stand without taking the required direct action! talk about concessions?


    §913. Possession of Firearm or Other Dangerous Weapon in Court Facility.

    (a) Offense defined.--A person commits an offense if he:

    (1) knowingly possesses a firearm or other dangerous weapon in a court facility or knowingly causes a firearm or other dangerous weapon to be present in a court facility; or

    (2) knowingly possesses a firearm or other dangerous weapon in a court facility with the intent that the firearm or other dangerous weapon be used in the commission of a crime or knowingly causes a firearm or other dangerous weapon to be present in a court facility with the intent that the firearm or other dangerous weapon be used in the commission of a crime.

    (b) Grading.--

    (c) Exceptions.--Subsection (a) shall not apply to:
    (1) The lawful performance of official duties by an officer, agent or employee of the United States, the Commonwealth or a political subdivision who is authorized by law to engage in or supervise the prevention, detection, investigation or prosecution of any violation of law.

    (2) The lawful performance of official duties by a court official.

    (3) The carrying of rifles and shotguns by instructors and participants in a course of instruction provided by the Pennsylvania Game Commission under 34 Pa.C.S. § 2704 (relating to eligibility for license).

    (4) Associations of veteran soldiers and their auxiliaries or members of organized armed forces of the United States or the Commonwealth, including reserve components, when engaged in the performance of ceremonial duties with county approval.

    (5) The carrying of a dangerous weapon or firearm unloaded and in a secure wrapper by an attorney who seeks to employ the dangerous weapon or firearm as an exhibit or as a demonstration and who possesses written authorization from the court to bring the dangerous weapon or firearm into the court facility.

    (d) Posting of notice.--Notice of the provisions of subsections (a) and (e) shall be posted conspicuously at each public entrance to each courthouse or other building containing a court facility and each court facility, and no person shall be convicted of an offense under subsection (a)(1) with respect to a court facility if the notice was not so posted at each public entrance to the courthouse or other building containing a court facility and at the court facility unless the person had actual notice of the provisions of subsection (a).

    (e) Facilities for checking firearms or other dangerous weapons.--Each county shall make available at or within the building containing a court facility by July 1, 2002, lockers or similar facilities at no charge or cost for the temporary checking of firearms by persons carrying firearms under section 6106(b) or 6109 or for the checking of other dangerous weapons that are not otherwise prohibited by law. Any individual checking a firearm, dangerous weapon or an item deemed to be a dangerous weapon at a court facility must be issued a receipt. Notice of the location of the facility shall be posted as required under subsection (d).

    (f) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection:

    "Dangerous weapon." A bomb, grenade, blackjack, sandbag, metal knuckles, dagger, knife (the blade of which is exposed in an automatic way by switch, push-button, spring mechanism or otherwise) or other implement for the infliction of serious bodily injury which serves no common lawful purpose.

    "Firearm." Any weapon, including a starter gun, which will or is designed to expel a projectile or projectiles by the action of an explosion, expansion of gas or escape of gas. The term does not include any device designed or used exclusively for the firing of stud cartridges, explosive rivets or similar industrial ammunition.

    §908. Prohibited offensive weapons.

    (a) Offense defined.--
    A person commits a misdemeanor of the first degree if, except as authorized by law, he makes repairs, sells, or otherwise deals in, uses, or possesses any offensive weapon.

    (b) Exceptions.—

    (3) This section shall not apply to any person who makes, repairs, sells or otherwise deals in, uses or possesses any firearm for purposes not prohibited by the laws of this Commonwealth.

    (c) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection:

    "Firearm." Any weapon which is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any such weapon.

    "Offensive weapons." Any bomb, grenade, machine gun, sawed-off shotgun with a barrel less than 18 inches, firearm specially made or specially adapted for concealment or silent discharge, any blackjack, sandbag, metal knuckles, dagger, knife, razor or cutting instrument, the blade of which is exposed in an automatic way by switch, push-button, spring mechanism, or otherwise, any stun gun, stun baton, taser or other electronic or electric weapon or other implement for the infliction of serious bodily injury which serves no common lawful purpose.

    Why are they not stepping up and being that guy or gal that solves this problem?

    I like a few Other spend several hundred hours getting all the prep work done before the rallies as a UN PAID volunteer and like all of you I have family commitments to my time, so I work extra during my lunch time, late after everyone else is sleeping in to the wee hours of the morning days, weeks and months before doing all of this the rally, I pay the cost with lost sleep to find the extra time to do the rally prep. Its a thankless task, like many of you I don't got lots of money, so I freely give my time to support the cause with passion along with direct action where i know I can make a difference.

    Thankfully the day of the rally, there are enough people that show up with Generous offers to help out and willing to do anything that is asked of them to make these rally done with a shoestring budget a Big Success.

    We have worked with the capital police and the legislators to get some kind of paperwork to make sure that you get your same firearm back, in the same condition with a receipt that covers both parties. You wouldn’t want your handgun to go missing now would you? Especially since there is not enough individual lockers to properly secure them. Without some of this information how you prove which one was handgun if it went missing?

    Hence some of the requirements of the Capitol Police paperwork may not be in the statute, per say but their are their for your protection and to make sure you get your handgun back. Some of you have NOT looked at the larger picture, most of which we have solved, with meeting the self defense needs between your home and the capital and the reality of the political situation in HBG.

    At past rallies, when the building exceeded the allowed people capacity in the building at any one time the Capitol Police simply turned people away and refused to allow them enter.

    The Capitol police was going to simply turn you away when all the firearm lockers were filled.
    Would that be acceptable to anyone? .

    We spent the time to solved that problem, they and US complained about not enough lockers, we partial solved that one with having them store handgun in another location and got (some money) for many more lockers to help relive the problem most of the time other than the big rallies with checking / securing firearm. We have done our extra part to make sure your handguns are secure when you visit the capital. How much extra do we have to keeping doing, to please people? If you still want to carry a long gun Where is their responsibility to solve their problem with this policy?

    Go any other day to HBG carrying your long guns with that the specific purpose of making your political statement or better yet have your own rally with that being the sole intent, let me know when your rally is.

    I DO NOT want to be coordinating a rally and have someone say they did could NOT check their long guns that day make a big scene and say they didn’t know. Worse would be giving something for the other side to use against us with a incident, like make ALL the capitial grounds and buildings a gun free zone.
    Would this make some of you happy because of one or two self center jerk off, with their own agenda, they even could be paid to disrupt this event to make all of US look bad. The stakes are that high to discredit this events.

    I have enough difficult problems that day without someone adding any extra burden on anyone. We will make sure your handgun are secured properly, how much extra do we have to go to please everyone?
    Really what extra effort are you prepared to do?

    IF this is important to you, WHY don’t you be that guy or gal that solves the problem with storage of your long gun now? You got the "free" time that we don't.

    Years ago we used to walk almost anywhere in the capital complex with our handguns, even OC, all you had to do was show your valid LTCF permit at the door. No Big deal. Then came the policy change and after 9-11-01 not enough people complained about this so now we are stuck with this. I complained about the policy change to just secure the courtrooms so did a few Other, not enough said anything then…… did any of you?


    This rally and interactive lobbying event is about personally getting gun owners involved, teaching them how to interface with legislator, be effective, fight for their rights and working within the system to change the parts of the UFA we don’t like or puts unfair burden on gun owners without any provable criminal deterrent. If enough of US would actually start getting involved in the political process, instead of just complaining maybe we can get what states like Texas has anyone with a valid LTCF permit gets
    expedited through security and back to keeping our handguns while visiting the capital, except the places specified in the law.

    We (all of us not the few) also could get this policy reversed, including large parts of the UFA, not by the few of US, its going to take many of you personally getting involved with this and other parts of legislation to change the current conditions that by our silence, apathy or indifference was allowed to be created.

    This is what needs to be changed, more people being personally involved, not sitting on the sidelines, actaully engaged in the Fight.


    Rather than take the focus of this thread into another tangent again.

    Because for some self center people “it’s only about me and my gun”,

    Please start another thread on the subject and work to solve this problem with storage of anything else beyond hand guns at the rally or any other day in HBG, Otherwise who is really conceeding then?.



    This is the short version of what needs said on this subject but anything longer will only serve to complicate and confuse these thread away from the main subject! Also have wasted some my rally prep time addressing this subject again, another year later....

    We have many proposed legislative correction to the UFA for the session that actual some of you could support, to address some of your complaints with the UFA. This is the focus, the purpose of this rally & lobbying effort.
