    Default Bob Durgin Caller

    Claimed that an out of state gun must be "registered" in PA in order to be carried. I did not know about that. Is it true?

    It is not true, and it is nonsense.
    While many claim to support the right, precious few support the practice.

    Yep. Nonsense. Its actually against the law for any authority in this state to maintain a firearm registry. I dont have the statute on hand, but someone will be along shortly to show you.

    No, he claimed he had been pulled over, detained, and had to go to a judge to get his gun back, all because the gun he carried was not "registered" when he moved to PA.

    Then he had his rights violated and needs to file complaints against the officers involved.

    There is no firearms registry in Pa. It's illegal to maintain one, and there is no way to "register" a firearm.

    18 Pa. C.S.A. § 6111.4. Registration of firearms.
    Notwithstanding any section of this chapter to the contrary,
    nothing in this chapter shall be construed to allow any
    government or law enforcement agency or any agent thereof to
    create, maintain or operate any registry of firearm ownership
    within this Commonwealth. For the purposes of this section only,
    the term "firearm" shall include any weapon that is designed to
    or may readily be converted to expel any projectile by the
    action of an explosive or the frame or receiver of any such
    weapon.

    The Pa State Police do maintain a limited database of certain pistol sales, but it is far from complete and cannot legally be used as a registry.

    It happens. The caller didn't break Pa. law, the police did.

    If he had broken the law, he would have been charged rather than getting his gun back.

    We have had a number of members on here who have had their guns taken away and they had to go back later and recover them. People carrying a relative's gun. People with FFls or C&Rs carrying guns not transfered through the PICs system. Transfers between spouse, etc. It happens.
