    Default Open or concealed?

    If a concealed firearm (with LTCF) accidentally or inadvertently becomes visible, is it considered an "open carry" in PA ?

    Concealed is concealed. It doesn't matter if it does become visible, as open carry is legal with or without a licence.

    With one exception, "cities of the first class" which requires a license regardless of OC or CC. Currently in PA Philadelphia is the only such city.

    There is no such thing as "open carry" under law. There is just carry, and concealed carry. Concealed Carry requires a LTCF. So if you were carrying and it inadvertently became concealed you would need a LTCF. If you were Concealed Carrying, which requires a LTCF, and it became visible, it means nothing legally. A visible weapon is not even RAS for a stop in PA (outside of Philadelphia where a LTCF is required for all carry.). The only time a Concealed Carried weapon being visible would have any legal implications would be while visiting a State Park, which requires Concealed Carry unless certain exceptions are met.

    I wouldn't agree that a visible weapon even in Philly is grounds for a stop. What is the RAS that the person doesn't have a license?

    Carrying in Phila is a crime, with an exception. That's how cops view it, especially the PPD. We're not talking about "in Theory". We're talking about "in Reality".

    It's considered "now you see it".

    When the wind stops blowing, it's considered "now you don't".


    These may, or may not be legal definitions, so consult an attorney before proceeding out on a breezy day.
