I hope one of the mods is going to collate these various decisions about recording police in their official capacity and stickey them, it certainly comes up as a question often enough that its worthy.

    NEVER MIND, I got it

The email I sent to the Smerconish show:

ETA: Right after I fired off that email, one of my attorneys sent an email to the Smerconish show as well, citing even more caselaw and correcting them.
can you post the case law for future references.

Did anyone record this morning's Dom G? There's an mp3 up for 5/17, but Ramsey doesn't appear to be on it.

    Hey guys:

This has picked up a LOT of momentum on the National level. Tonight, the Lars Larson show will be having me on as a guest at 8:05pm our time. The link to his page is here: http://www.larslarson.com/ - you can listen live tonight, and the podcast from this morning's show (which I haven't listened to yet) goes into this story as well.

Secondly, Michael Smerconish personally called me this evening to apologize for the caller who is an ex-ADA who said I committed a third-degree felony by recording the police without their knowledge. He talked to his legal rep for the show and his initial instinct was correct, that there is no expectation of privacy for police officers performing their public duties. He's going to be making a correction on tomorrow's show during the 3:00 segment, then will be airing a Commissioner Ramsey interview on this topic. I am planning to be on the air with him at 3:30 to discuss this further.

I was listening to Smerconish today and I almost crashed my car because I was so mad at that ex-ADA making light of police brutality in "the old days".
