I hope one of the mods is going to collate these various decisions about recording police in their official capacity and stickey them, it certainly comes up as a question often enough that its worthy.

WHERE IS THE CASELAW about taping the police being legal? I need to send an email to T.C. - I still have her email address and I want to know why they don't screen the idiots out of their caller line! I need that caselaw to back myself up.

He talked to his legal rep for the show and his initial instinct was correct, that there is no expectation of privacy for police officers performing their public duties. He's going to be making a correction on tomorrow's show during the 3:00 segment, then will be airing a Commissioner Ramsey interview on this topic. I am planning to be on the air with him at 3:30 to discuss this further.

I was listening to Smerconish today and I almost crashed my car because I was so mad at that ex-ADA making light of police brutality in "the old days".
