Upper Darby man arrested after cache of guns found in home
Published: Tuesday, February 08, 2011
By Linda Reilly, Times Correspondent
An Upper Darby man who allegedly threatened to shoot and kill 12 doctors at a Philadelphia hospital where his daughter had been treated for cancer has been arrested, police said.
Robert Bruce Dalrymple, 58, of the 100 block of South Cedar Lane, was taken into custody after police raided his house and confiscated 21 guns and numerous boxes of ammunition at 8 p.m. Monday.
According to police Superintendent Michael Chitwood, Dalrymple allegedly made the threat against physicians at Fox Chase Cancer Center to a visiting nurse caring for him at his house. Dalrymple's daughter died of cancer in May.
"We checked with state police and determined Dalyrmple is the registered owner of nine assorted handguns," Chitwood said. "We got a search warrant and confiscated numerous rifles, handguns and ammo."
Dalrymple was transported to the hospital for a psychiatric evaluation and released within two hours.
Magisterial District Judge Michael Cullen arraigned Dalyrmple on Tuesday morning on charges of terroristic threats and harassment.
He was jailed in lieu of posting 10 percent of $50,000 bail with the stipulation he have no contact with the doctors should he be released on bail.

Chitwood needs some jail time over this, as does his contact(s) at PSP. It's also time for our new Governor to step up and do the right thing, the thing he promised he would do. End it NOW!!

Re: They'd never use the "Record of Sale" database to confiscate someone's firearms..
I'm less concerned with the use of the database that they really shouldn't have, than with the trend towards charging people with "assault" for acts done several steps and many miles removed from the "victims".
It's been that way with the President for a while, you can be arrested for casual comments made in a bar in New Mexico regarding your antipathy for the current occupant of the Oval Office, sitting 2,500 miles away from you, and in no danger whatsoever. You don't need to be armed, you don't have to show any intent to do anything about it. He's "royalty" and you are not allowed to even speak the bad words about him to any of your fellow serfs.
Now they're charging this guy with assaulting these doctors, for being enraged that they let his daughter die. He apparently was in his own home, talking to a person who was theoretically there to HELP him, probably just venting, and she dimed him out for it.
They couldn't charge him with "attempted murder", they'd be laughed out of court. But the traditionally laughable PD in Upper Darby (I'm guessing that Chitwood doesn't display clippings for most of the news stories about the various corrupt and inept doings by the government and PD of Upper Darby) went ahead and charged him under the "assault" statute:
Title 18 Pa.C.S.A. Crimes and Offenses
Part II. Definition of Specific Offenses
Article B. Offenses Involving Danger to the Person
Chapter 27. Assault
§ 2706. Terroristic threats
(a) Offense defined.--A person commits the crime of terroristic threats if the person communicates, either directly or indirectly, a threat to:
(1) commit any crime of violence with intent to terrorize another;
(2) cause evacuation of a building, place of assembly or facility of public transportation; or
(3) otherwise cause serious public inconvenience, or cause terror or serious public inconvenience with reckless disregard of the risk of causing such terror or inconvenience.
§ 2709. Harassment
(a) Offense defined.--A person commits the crime of harassment when, with intent to harass, annoy or alarm another, the person:
(1) strikes, shoves, kicks or otherwise subjects the other person to physical contact, or attempts or threatens to do the same;
(2) follows the other person in or about a public place or places;
(3) engages in a course of conduct or repeatedly commits acts which serve no legitimate purpose;
(4) communicates to or about such other person any lewd, lascivious, threatening or obscene words, language, drawings or caricatures;
(5) communicates repeatedly in an anonymous manner;
(6) communicates repeatedly at extremely inconvenient hours; or
(7) communicates repeatedly in a manner other than specified in paragraphs (4), (5) and (6).Attorney Phil Kline, AKA gunlawyer001@gmail.com

Re: They'd never use the "Record of Sale" database to confiscate someone's firearms..
At least they only used the legal information in the non database because he only had nine "registered" guns the rest of the firearms were not in the PSP non database, so as you can clearly see its not a complete database as they didn't know about the others and perfectly legalize by the pretzel logic of the PA supreme court ACSL vs PSP, that as long as its not complete database its "legal" to keep and use.
Take the time to read the link in anonymouse post for the background on the PSP non database.
Gee his daughter died many months ago in May and he is still taking it rough and they made this into a thought crime because he owed firearms?
As GL said someone that he probably was reaching out to for help him get past this resentment turned him in.
WHY?
They really did him a favor now.....
wonder why people don't trust the people that say "we are here from the government, we are only here to help you out" anymore.

Gun Lawyer makes it sound a lot like we were told Russia was like when i was in high school in the 60s. Wonder if those statutes are part of the patriot act, which just got renewed. Bye bye freedoms.

Re: They'd never use the "Record of Sale" database to confiscate someone's firearms..
Looks like this is their 2nd attempt to charge him for the same thing they previously did.
See the 2 links below for the docket information:
First charges from 04/11/2010

Second charges filed recently are from the same charges which they didn't get through the first time.
