Default Re: CLEOs / Countys That Sign NFA Forms

    Jaybell,

I never said "this is what the form says"

I wrote "This is what the this section is doing"

All Title II devices are legal in all of PA.
Why would the CLEO need to sign off on that? Why should that impede your ability to physically own an NFA device in PA?

That being said how does my CLEO know what I intend on doing with a device? Is he a mind reader? Why would the CLEO need to attest to that? Why should that impede your ability to physically own an NFA device in PA?

Yeah because I cant buy it. That means I cant paper it.

    Lets just delete this thread.

People are more concerned over nitpicking statements than posting whats supposed to be here.

Adams County - Sheriff Muller will sign.

York County - Sheriff office will sign they charge a fee and do a PICS and warrant check. Process takes 2 weeks.

Cumberland County - Sheriff stated he would sign on a case by case bases for suppressors.

no, I'm more concerned that you keep your statements truthful about what the paperwork says... you cant even properly be accurate about what YOU said a few posts earlier.

    Jaybell,

Cool. I guess your right, and frankly I could give a shit about the technicalities of a post.

This thread is for posting CLEO info. If were not doing that lets not post at all.

You should probably go with the "not post at all" option here.

Some of us have been involved in NFA matters for decades, and we have some pretty fair insights into the realities, insights that more recent fans may not have stumbled onto yet. As Jay Bell posted earlier (and you seem to have ignored), the last thing that most CLEO's want is publicity about this.

At least one CLEO was sued over his signing, in a Dayton, Ohio case. The court dismissed him from the case early on, but it was a hassle, and one that he could have avoided by refusing to sign. From any politician's standpoint, getting hassled without benefit is not as good as avoiding the hassle in the first place, by simply saying "no".

In PA, CLEO's are not required to sign NFA paperwork. You can try to get a writ of mandamus; you'll lose. Those who sign are simply honorable public servants who see no reason to confound honest private citizens. Other CLEO's have different priorities. But those who sign don't expect that you'll put their names up on a billboard so that it becomes a controversy.

So making a list of those who are helpful to the law-abiding, and posting it out there for the haters who want more gun control, is a bad idea, if you are on our side of the fence. If you want to make it harder for anyone to own NFA firearms in PA, then by all means, collect this info from well-intended gun owners and put it on the Web for the ease and convenience of the twits who want to ban all guns, so they can send letters to the county commissioners and town mayors.

As for the "nit picking", it's not a truthful statement that all NFA firearms are allowed in PA. Read the Prohibited Offensive Weapon statute. All bombs are flat-out illegal. Machineguns are illegal, but you can own one if you comply with NFA requirements.

I'd remove the specific names and jurisdictions from this thread. But that's just me, and I value my gun rights. You may be different.

Correct. Bombs, hand grenades, live motors and arty rounds, etc fall under exploding DDs.

PA law allows you to possess a grenade launcher, or mortar, or other DD that isn't a "bomb". Plenty of folks in PA have M-203's that they use for practice chalk rounds, beehive rounds, sub-cal shotgun shell adapters, etc. Just nothing that explodes with any significance.
