Non-Resident CCW (FL) at King of Prussia Mall okay?
I live in the People's Socialist Republic of New Jersey and am in the process of getting my Florida non-resident CCW. My wife and I shop at King of Prussia Mall often. My question is, will I be able to legally carry a concealed firearm in that mall with my Florida CCW?

Re: Non-Resident CCW (FL) at King of Prussia Mall okay?
I'm not a lawyer. How I understand the law in NJ is it's iilegal to have a handgun outside of your home unless you have a NJ carry license(or whatever they call it).....OR you fall under an exemption. Unless of course you're a cop......or armed guard while on duty.
No NJ license & no exemption + handgun = jail time. OP...make triple sure you come under an exemption. I would talk to an lawyer in NJ who knows NJ gun laws before transporting a handgun to PA & back for the purpose of carrying it in PA.

Re: Non-Resident CCW (FL) at King of Prussia Mall okay?
The issue has nothing to do with Federal vs. state law.
Federal law wouldn't apply since the starting and ultimately, ending destination is NJ.
After what happened to Brian Aitken, I would be hesitant to drive around in NJ with a gun.
My arm chair legal opinion (and the opinion of many others on this site), is that you CANNOT bring a gun to PA to carry around.Last edited by uniballin; December 18th, 2010 at 06:45 AM.

Well... that is certainly a very colorful and creative spin on FOPA, I don't suppose you have a citation for it? I always regarded that any trip had it's own destination, ie, the King of Prussia Mall in this instance would be the first destination. Does each "trip" stand on it's own? I don't see anything in FOPA regarding different laws for different types of trips.
Although I don't think there is any FOPA or federal violations in the OP's scenario, it is still NJ's laws that I fear will jack him up, as it appears his transportation of a firearm does not meet the enumerated exceptions.
I think NJ makes it quite clear that "driving around with a gun" is illegal, and I would be a lot more than "hesitant", since Brian's defense isn't working out so well for him. While many claim to support the right, precious few support the practice.

Not withstanding the merits for or against the various interpretations of FOPA, keep in mind that Brian is in the situation he is in because his mother thought it wise to call the police and tell them he had a gun.
As to the OP's original question, I think it would be safe to say (IANAL) that he is unlikely to be hassled should he be found with a gun in PA and has a FL CCW. Unfortunately, it may be at best a financially expensive proposition should he get caught en route to PA while still on the NJ side of the river. Worst case, felony, jail time and permanent loss of the right to own guns.Vortex
