    Default Firearm Confiscation

    What are our rights regarding confiscation?

    I've read stories of people having their firearms confiscated by authorities during searches after they were asked if they have any weapons. In all the cases, the owner was truthful, not hostile, owned the firearms legally, and complied with the officer.

    Can they just take your weapons without probable cause or a reason?

    They can do whatever they want. It then remains to be seen if anyone will punish them for what they did. If not, they will do it again. If so, they may or may not continue doing it, depending upon the punishment.

    Goes for pretty much any situation with a LEO...

    I recommend that you never let any LEO get his hands on your firearms if you can legally avoid it, because you only get it back if he feels like handing it back. You can't wrestle him for it, and he is shielded by some degree of immunity that your neighbor wouldn't have if your neighbor grabbed your property and ran off with it.

    Cops know that the transaction cost for you to get any property back starts at $500 or so in court filing fees and attorney fees, and goes up from there. So they can steal anything worth less than that from you, and the odds are that you won't do squat to get it back.

    We've seen many excuses for such unjust seizures, from "you have to conceal that", "you need a Pennsylvania license", "we only honor Philadelphia County licenses in this city", and worse.

    Pay the $500 dollars and then obtain legal advice to sue the LEO both personally and as government. When people act outside their authority, they risk losing all they own or having a lien placed against any thing they may own.

    You are under the assumption that the court is on your side simply because the law is explicit. If that were the case, this thread and others like it wouldn't even exist.

    If the law is explicit you will prevail. Many of these threads exist because we have let the legislature pass illegal ordinances, allowed the police to engage in wrongdoing and have been complacent. You either fight for your rights or you will lose them.
