Had my LTCF taken from me at the courthouse
It expired yesterday, but can they confiscate it? Are you required to turn it in?
I was told Yes to both.
Went up to renew my license and they were completely clueless on how to process a paper license. They said they never do them because everyone just pays the 46 for the plastic. I was turned away last visit because I didn't have my passport photos, today I was told to keep them cause they are only
Needed if approved.
They took my LTCF and stated since it is expired she had to confiscate it from me.
Just curious if they can do that.
Anyways.... Delaware County Sheriffs office is all messed up
PS: I paid 25.00,Last edited by BimmerJon; November 22nd, 2010 at 03:24 PM.

No there is no law about turning in an expired license. In fact, depending how you look at it, the license is still "good" for six months AFTER it expires (though technically it is just an exception).
(a) Offense defined.--
(1) Except as provided in paragraph (2), any person who carries a firearm in any vehicle or any person who carries a firearm concealed on or about his person, except in his place of abode or fixed place of business, without a valid and lawfully issued license under this chapter commits a felony of the third degree.
...
(b) Exceptions.--The provisions of subsection (a) shall not apply to:
...
(12) A person who has a lawfully issued license to carry a firearm pursuant to section 6109 (relating to licenses) and that said license expired within six months prior to the date of arrest and that the individual is otherwise eligible for renewal of the license.I am not a lawyer and nothing I say should be construed as legal advice.

And if you hadn't had it with you? What if you flat out refused to give it to them? Would they contemplate subduing you physically, removing by force, and or charging you with some crime?
There is no statutory requirement to turn in an expired license, and absolutely NO authority to confiscate it.
It can be revoked, at which point you are required by law to surrender it, but there is no statute which provides for it to be confiscated.
