Default Had my LTCF taken from me at the courthouse

It expired yesterday, but can they confiscate it? Are you required to turn it in?
I was told Yes to both.

Went up to renew my license and they were completely clueless on how to process a paper license. They said they never do them because everyone just pays the 46 for the plastic. I was turned away last visit because I didn't have my passport photos, today I was told to keep them cause they are only
    Needed if approved.

They took my LTCF and stated since it is expired she had to confiscate it from me.

Just curious if they can do that.

Anyways.... Delaware County Sheriffs office is all messed up

    PS: I paid 25.00,

No there is no law about turning in an expired license. In fact, depending how you look at it, the license is still "good" for six months AFTER it expires (though technically it is just an exception).

    (a) Offense defined.--
    (1) Except as provided in paragraph (2), any person who carries a firearm in any vehicle or any person who carries a firearm concealed on or about his person, except in his place of abode or fixed place of business, without a valid and lawfully issued license under this chapter commits a felony of the third degree.
    ...
    (b) Exceptions.--The provisions of subsection (a) shall not apply to:
    ...
    (12) A person who has a lawfully issued license to carry a firearm pursuant to section 6109 (relating to licenses) and that said license expired within six months prior to the date of arrest and that the individual is otherwise eligible for renewal of the license.
Maybe you can report it stolen? You are still able to legally carry concealed and in a vehicle. Though based on the wording if seems as if you could still be arrested but not convicted? Maybe someone can clarify that for me.
I am not a lawyer and nothing I say should be construed as legal advice.

an expired ltcf is no longer a ltcf. It's scrap paper.

I brought up the 6 month thing to the LT and it was not acknowledge.

FYI: you can still be arrested but it should cover you in court

And if you hadn't had it with you? What if you flat out refused to give it to them? Would they contemplate subduing you physically, removing by force, and or charging you with some crime?

There is no statutory requirement to turn in an expired license, and absolutely NO authority to confiscate it.

It can be revoked, at which point you are required by law to surrender it, but there is no statute which provides for it to be confiscated.

Do you have any intentions on following up on this further?

I would. I figure it all starts with a letter, could use some help.

I was very verbal that I wanted it back and was not consenting. I also asked for a receipt.
At that point everyone was looking at us, and other officers walked over so there is no shortage of witnesses

Would you be opposed to an in-person meeting with the Sheriff (assuming you were prepped and had applicable statutes in hand)?
