    Default LCTF

    I am LCTF, but i was just thinking, Isn't the 2nd amendment my LCTF? what happens to those who carry without license issued by sheriff?

    If they are carrying concealed or in a vehicle (and not meeting one of the exceptions) then they would charged with either a third degree felony or a first degree misdemeanor.

    18 Pa.C.S. § 6106: Firearms not to be carried without a license
    (a) Offense defined.--
    (1) Except as provided in paragraph (2), any person who carries a firearm in any vehicle or any person who carries a firearm concealed on or about his person, except in his place of abode or fixed place of business, without a valid and lawfully issued license under this chapter commits a felony of the third degree.
    (2) A person who is otherwise eligible to possess a [FN1] valid license under this chapter but carries a firearm in any vehicle or any person who carries a firearm concealed on or about his person, except in his place of abode or fixed place of business, without a valid and lawfully issued license and has not committed any other criminal violation commits a misdemeanor of the first degree.

    . . . and being convicted of either, regardless of the actual sentence, makes you "prohibited" and permanently forbidden to touch a firearm or ammunition. The courts have consistently held that these laws are constitutional. Will some of them fall after Heller and McDonald? Hopefully, but those rulings left latitude for the states to regulate carry -- how much latitude will be fought out in the courts over the coming years.

    No, no the courts haven't, at least not the Supreme Court anyway; they specifically DID NOT ADDRESS licensing in Heller or McDonald, because neither Heller nor McDonald challenged that aspect of the laws at hand.

    They actually stated, several times, in both opinions, that they weren't addressing licensing as an issue, which means they neither upheld licensing nor struck it down.
