    Default PA wine and spirits

    Is it legal to open carry in a PA wine and spirits store? I was told today that I could not be in the store and have my firearm.

    It's not a prohibited place so it is legal.

    Prohibited places (from the famous flyer):

    - ANY Court facility Ref: 18Pa.C.S. §913
    - ANY Federal facilities (unless authorized)
    - State Parks (LTCF holders are exempt for concealed carry)
    - Detention Facilities (adult & Juvenile)
    - Airport Terminals (secure areas only)
    - Philadelphia public streets unless you hold a valid LTCF or reciprocal license
    - Primary and secondary schools. Ref: 18Pa.C.S. §912.

    Carrying a firearm in establishments that sell or serve alcohol is allowed in Pennsylvania.

    Were you told you couldn't carry there by a store employee?

    Wine and Spirit stores are not private property so they are not exempt from preemption.

    Whoever told you that is full of shit. I regularly OC in the stores in Mountainhome, Mt. Pocono & Tannersville

    I just call and talked to a worker. The store manager is going to look into it.

    Employees, no; customers, yes.

    Unless you're like the guy at the Meadow Avenue store in Scranton today, who not only open carried, but pointed it at the cashier and stole the money!

    Are you kidding me?

    I used to deliver LTCF applications/PAOpencarry Trifolders/lildobe MPOETC 2009 excerpt packets to people that asked me about OC at those places. At least two of them went out and got LTCF/handguns.

    Not totally true, the property is privately owned, but leased by the State to sell Liquor as a "State Store"
