The dispatcher was right and this guy should be in jail. Those two men were clearly not threatening his life in any way.

yeah! Holy shit. Either this guy didn't understand the law or he saw it an excuse to kill someone for stealing SOMEONE ELSE'S stuff. People like this will make implamenting something like the castle doctrine in PA a hell fo a lot harder!

Granted, I'm no expert on Texas law, but I see this guy ending up facing murder charges.

The only questionable thing here is was he attacked - "charged" as he put it - on his property? Michael Smirconish aired the dispatcher's recording last week, and the shooter claimed the men rushed him in his yard when he ordered them to stop. If true, I think that will have a big influence on any determination.

In TX, if your neighbor asks you to watch his/her property - you can shoot to defend from theft as if it was his own. Its gonna come down to if the neighbor asked that guy to watch his property.

You can shoot for theft from your lands and buildings there.

No, he says "Move, and your dead" and then we hear shots.

Glenn Beck has been on this one quite a bit. 2 guys turned to him, moved onto his property, and made motions that he flet were threatening. Best of all, an undercover police officer watched the WHOLE THING GO DOWN, just didnt step in because he didnt want to be mistaken as an accomplice to the burglary.

So far he is facing no charges, he did everything in the right of the law. Texas allows for you to protect property and life with force, and he was asked by the owner to watch the house. That makes him the steward of the property.

Granted, the shooting happened on this man's lawn, so under the law, he still had the right.

I read that is exactly what occurred...The neighbor, away from home for awhile, asked this guy to "watch" his property. He did a good job of it in my opinion.

While I agree that he did do a good job, and he may even have been within the law, it is hard for me to justify taking the life of a human being in response to his taking material possessions. Those possessions can be replaced, but a human life can't. I know they were wrong for stealing, but I don't think I could take their life for it. Now if they threatened me or I felt my safety was jeapordized, then it is a different story.
So, unless his safety was at risk, I think he was morally wrong, even if legally permitted, to take their lives.

And convicted criminals both here and abroad???
If so, any and all blame, other that that which they brought upon themselves by committing crimes, falls squarely upon the uninforced immigration laws and the government officials that have failed to do their assigned jobs by preventing these two criminals from being in that mans' yard in the first place.
Feeding, clothing, housing and in general "caring " for these lawbreakers, just show how much we have failed as a society by being "nice" to these criminals in the first place.
Ted Nugent says:" I don't like repeat offenders, I like DEAD offenders."
Personally, I agree.
