    Default Consigning a Firearm

    I want to consign a pistol to a local gun shop for resale. If it does not sell, I will want to retrieve it, so don't want to transfer to the gun shop/FFL. If it does sell, however, obviously the shop will run the PICs check and hand the pistol over to a (qualified) buyer.

    Question: What paperwork/receipts, etc, is necessary between me and the gun shop for me to consign it to the shop?

    That's not the way it works. Federal law requires the dealer to enter it into his bound book when he takes possession of it. He cannot sign it back out of the book to either a buyer or it's original owner without the completion of a PICS/NICS check.

    Greg has it correct.

    From the BATFE:

    Must a dealer record firearms received on consignment?

    Yes. Firearms received for sale on consignment must be entered in the dealer’s “bound book.”

    Sales of the firearms are handled in the same manner as other firearm sales.

    Return of the remaining firearms by the licensee to the consignor is entered in the dealer’s disposition record. An ATF Form 4473 and a NICS check must be completed.
