    Angry Non Resident LTCF

    First of all Hello. I just got back home Beaver Falls, and went to the Beaver Sheriff's they don't issue non-resident license's. You need to update the county data base to reflect this fact. I for one feel that since from what I have seen and read about the law, the sheriff can refuse to issue on criminal grounds only. If this is true is there any recourse?

    Centre County PA sheriff will issue to non residents who have a permit/license from their home state...and will do it all thru the mail...within about 2 weeks.

    My opinion is that all Sheriffs are required to issue to non-residents. The statutory language is "shall issue" to anyone who meets the requirements, regardless of their state of residency.

    The fact is that it's simpler to go to a different county instead of spending a couple of thousand dollars to force a stubborn sheriff to comply with the law is the reason the variance in practice exists.

    That is what I originally thought too. Isn't there a way to go over the sheriff, like the county law office. It is just frustrating that a sheriff can do this.

    Your recourse to "go over the Sheriff" would be to file for a writ of mandamus with the Court of Common Pleas in that particular county. A writ of mandamus forces an official to carry out some part of their mandated duties that they are not doing.
