Default Is this concealed or open carry

We discussed this at a PAFOA group meet. When does it become concealed carry? When is it open carry? The majority of this weapon is hidden. What if just the tip of the handle was sticking out? This made for some nice discussion. So I thought I would present it to you all. Remember, not everyone is 100% sure what open carry is and what concealed carry is. That's why this is here.

ummmmm opcealed carry??? I would have to say that would be considered open carry, because concealed to me is hidden from view. As far as carrying without a license i would have to say that since most LEO and DA are anti civilian gun, they would push it as concealed once they find out that open carry is legal. If one were to try this without a license you would have to be very careful not to let your shirt fall over the gun, you could go from legal civilian to BS criminal in about 2 seconds.

ETA: good topic, this should be a good discussion, i would love to know where the open vs concealed line is drawn. Ffor instance covered by a tight shirt, concealed but printing severely. Id give ya rep for startign this, but i guess i havent given enough to give you more.

That was one of the points that was brought up. If this isn't concealed carry, Is it truely open carry. MMMMMMMM

Your right about a slight mishap and you become a CCW carrier. But till then. Is this legally OPEN CARRY?

    It's open.

PA does not have a definition in the law.
So default to the dictionary definition of concealed.
Concealed means just that. Concealed from view. Not recognizable to the casual observer, hidden.
If you can tell it's a gun, it's NOT concealed.

Another state has a definition of open carry that supports the above by stating essentially that open carry is when the gun is recognizable as a firearm to a reasonable person.
Seems like a good guideline to follow since we lack our own

If it is obviously a gun, it's not concealed. But since it is not well defined it would be much safer to avoid the IWB open carry unless you have a LTCF which would make the open/concealed a moot point.

    when in doubt consult webster

1 : to prevent disclosure or recognition of <conceal the truth>
2 : to place out of sight <concealed himself behind the door>

    Still no definate awnser

    1. Not accessible to view; "concealed (or hidden) damage"; "in stormy weather the stars are out of sight".

    2. Concealed or hidden on any grounds for any motive; "a concealed weapon"; "a concealed compartment in his briefcase".

I would say if it is visable at all, and recognisable as a gun, it is open

"Open carry" is not a legal term. It's just a common term to describe carrying other than concealed .

"Concealed" carry is prohibited by ss6106 of the UFA and one exception is having a LTCF

The key is not "is it truly open carry" Because it's irrelevant. The key is whether it is truly "concealed" or not.

Yup, exactly. I've never seen a legal issue or opinion that said otherwise.

To you and I that is a gun. But to a lot of NON Gun types. They may wonder. So, who decides. Gun People or Non Gun People. I have had people ask me what that is in my belt if I wore it like this ( I think it was utter stupidity or they didn't want to believe it was a gun). So, they didn't know what it was, so......

IWB would be open carry. Put a shirt over it and you need a LTCF.
