Byrne: reaches into left pocket, grabs wallet, GRABS MY GUN WITH BOTH HANDS AND STARTS PULLING ON IT! he couldn't get it out, so he satisfied himself with removing the magazine.
Edit: It amazes me when an officer doesn't know how to operate a Serpa...

Sorry for the fragmentation. I keep getting a screen limiting number of characters.
Byrne at one point, just before the gun grab, made the comment that he needs to rum my gun to make sure it is registered.
Me: you know it's illegal to register a gun in PA1
Byrne: I just want to check if it's registered.
Me: YOU KNOW THAT'S ILLEGAL!
I don't know how I skipped over that from my notes.
Byrne then took my wallet back to another car, second or third in line, I couldn't tell. He emptied it and rifled everytrhing in it, including puictures of my little girl, jammed everything back in haphazardly and brought it back to me. he handed it to me. and asked, " why do you have a Utah CCW"?
Me: because i travel.
Byrne then attempts to hand me the mag back. i dtropped my hands and angrily stated: "You just violated my fourht amendment rights!"
Byrne: no, i didn't, you said i could.
Me: No, I did not! You just violated my fourth amendment rights!
Lightning cracks very close.
Byrne: if you will take your property you can get on your way and not get wet.
Ok, I am pissed off again just from reliving this while typing it out. What do you think i should do next?

I know I'd be pissed, but a complaint doesn't help. Yes, he certainly did violate you 4th A rights by rifling through the wallet. Whoever said that you didn't need the LTCF to OC on the bike was wrong, though; since the motorcycle is a conveyance, even though the gun is in plain view, it's still considered to be 'in a a vehicle'. Dura lex, sed lex, I suppose.

1. Why didn't you remove your wallet yourself? I think you consented to having them remove it, which allowed them to rifle through it.

I have had several conversations with friends, in and out of law enforcement. One of the LEO's with a dept over near PGh told me to start OC'ing my AR15. "Do it everynight on your walks. Drown them in "MWAG" calls. When you get interviewed by the newspapers, as you will, explain it is all because of Corporal Byrne". I have to admit, that is tempting. However, this is MY township. i have lived here for over 18 years. It is MY HOME. I care about the people of this community. I do not wish to scare or alarm any of them. I also do not wish to have my rights trampled.
I DID give permission to retrieve my wallet, but permission for the gun had already been established as NOT given. This is the Fourth Amendment violation I am complaining of. That, and the stop as a whole past the point of establishing what I did with Officer 1. Anything past that point is just Officer Byrne trying to humiliate a citizen. I think that is addressed under a law concerning Official Oppression.
Some of you may remember that this is not the first issue with Warminster PD. It is about two years ago now that one of their finest threatened deadly force against me, my wife , and my then 11 year old daughter for OC'ing in the township.Last edited by AxiTech; September 2nd, 2010 at 09:38 PM.

Sounds like you did your best to keep the traffic stop legal, if I were you I'd probably pursue the wallet search issue, but its been a couple of weeks since this occurred, right? I think it may have been better to address it at the time rather than waiting so long... not sure if the delay in reporting it would work against you or not.
FOR THE LIFE OF ME I CANT UNDERSTAND WHY PEOPLE WOULD TAILGATE BIKES. I don't get it. I'm not a motorcycle guy, its just not for me, but logic says give motorcycles EXTRA space - if we tag each other there is a much greater chance for injury to the motorcyclist than if I had a fender bender with a car.
