    Default NY May issue?

    Always here how difficult NY is in Issuing carry licenses.

    Need another set(s) of eyes to read this NY law

    NY PEN (4)(W) ss400.00(4-a)

    4-a. Processing of license applications. Applications for licenses
    shall be accepted for processing by the licensing officer at the time of
    presentment. Except upon written notice to the applicant specifically
    stating the reasons for any delay, in each case the licensing officer
    shall act upon any application for a license pursuant to this section
    within six months of the date of presentment of such an application to
    the appropriate authority. Such delay may only be for good cause and
    with respect to the applicant. In acting upon an application, the
    licensing officer shall either deny the application for reasons
    specifically and concisely stated in writing or grant the application
    and issue the license applied for.
    Is it just me...or does that say NY is actually Shall Issue?

    It seems all applications must be processed. I see nothing that restricts rejection other than having to specify the reason, which could give cause for appeal.

    Unrestricted permits for NYS (not NYC) are contingent to the area. Depends on the sheriff and judge.

    it's the last sentence that caught my attention...

    In acting upon an application, the
    licensing officer shall either deny the application for reasons
    specifically and concisely stated in writing or grant the application
    and issue the license applied for.

    It does not say anything about what those reasons can be and therefore it is solely up to the discretion of the approval authority. According to this law, "your feet are too big" is a valid reason as long as they put it in writing.

    AHHH....now i'm starting to get it...

    You have to remember that in NYS, they issue a couple different permits. The residence & target, and the full carry.

    Its the residence & target that is Shall Issue. The full carry is subject to the good cause issue where one must provide a need to be carrying.
