    thats interesting cuz i vividly remember the application in lehigh county having a line that says references have to be from lehigh county...

    We've explained to you several times, fill out the application with any references you want. Don't use their application (See below)

    You will notice the only requirements for references are:
    TWO REFERENCES – NOT FAMILY MEMBERS

    Whatever bastardized form Lehigh County or Schuylkill County use is illegal.

    edv177, use the COMMONWEALTH OF PENNSYLVANIA APPLICATION and submit that to Sheriff Barbra.

    She may have been sweet about it on the phone, but she is still trying to bend you over and take advantage of you.

    Don't let it happen. Why should you have to supply a Schuylkill County resident? The law doesn't require it.

    Try to go again when there are different employees at the window. Dress up a little bit. Submit the STANDARD application, not the one that they give. Say that you want an LTCF and hand over the application. Don't say anything about the references, don't even ask if it is ok.

    That's how I did in Lackawanna and left 15 minutes later with my LTCF, even though they also request in-county references and I didn't have any. If they still refuse, then by all means bring out the guns (figuratively speaking).

    This is going to sound really self-promoting, but what the Hell, it's true: If you expect trouble in a situation like this, spend the coin to bring a lawyer along.

    This does 2 things (3, if you count "keeping lawyers employed"): It shows that you are a serious player who will not just go away; and it allows the lawyer to rebut the bullshit in terms that the LEO will understand. Cops don't really try to bluff practicing attorneys on legal matters. The Sheriff can claim whatever she wants, but the lawyer can cut through the crap and ask "which part of Chapter 61 of the Crimes Code authorizes that, because my reading of the prohibitors and application process of Section 6109 says nothing at all about the Sheriff having the discretion to deny for 'location of friends'."

    Paying a lawyer for an hour to avoid a problem is better for you than paying a lawyer for 15 hours to research, draft, and attend an appeal. It's like stopping that leak in your upstairs bathroom now, or waiting to see if it collapses the floor into the kitchen later.

    MISSION ACCOMPLISHED. Said application will be processed. I had a very friendly talk with Sheriff Groody. Nice guy.
