    Default Chester Mayor Declares State Of Emergency

    In response to a recent string of shootings, Mayor Wendell N. Butler, Jr. of Chester held a press conference to announce that the city is declaring a State of Emergency.

    According to city officials, the State of Emergency goes into effect Saturday evening and will remain in effect for the next five days with the possibility of 30 more days.

    The bloody week in Chester City culminated with the killing of Yadullah Muhammad of Upland, a 22-year-old man who was shot and killed late Wednesday.

    According to the Delaware County Medical Examiner's Office, Muhammad was shot in the 2700 block of Lehman Street just before midnight and later died at Crozer-Chester Medical Center.

    The previous weekend saw two unsolved shooting incidents. Sunday morning, 2-year-old Terrence Webster was shot in the head as his family was returning home to West Ninth Avenue after visiting relatives and on Friday, Raymar Holmes, 26, was found lying in the 1300 block of Crosby Street with gunshot wounds, according to police.

    There is no word on what caused any of these shootings and police are still working to develop suspects.

    In the wake of the shootings the antiviolence initiative, Mayor's Night Out Tour, was created, starting Thursday night with a rally at the William Penn development at Fifth and Franklin Streets.

    As part of the State of Emergency, Chester City officials will dispatch what they're calling "saturated patrol units" and enforce a curfew in five of the worst sections of the city.

    If you OC there and don't have your LTCF be aware... It's a declared State Of Emergency by the town official. That means anyone OCing (or CCing of course) there MUST have a LTCF (or be exempt).

    18 Pa.C.S. § 6107: Prohibited conduct during emergency

    (a) General rule.--No person shall carry a firearm upon the public streets or upon any public property during an emergency proclaimed by a State or municipal governmental executive unless that person is:
    (1) Actively engaged in a defense of that person's life or property from peril or threat.
    (2) Licensed to carry firearms under section 6109 (relating to licenses) or is exempt from licensing under section 6106(b) (relating to firearms not to be carried without a license).

    (b) Seizure, taking and confiscation.--Except as otherwise provided under subsection (a) and notwithstanding the provisions of 35 Pa.C.S. Ch. 73 (relating to Commonwealth services) or any other provision of law to the contrary, no firearm, accessory or ammunition may be seized, taken or confiscated during an emergency unless the seizure, taking or confiscation would be authorized absent the emergency.

    (c) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection:
    "Accessory." Any scope, sight, bipod, sling, light, magazine, clip or other related item that is attached to or necessary for the operation of a firearm.
    "Firearm." The term includes any weapon that is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any weapon.

    When a politician calls for a state of emergency,

    what are the benefits the city then has?

    Money from feds?

    Unjustified, by unjustified I mean then no longer have to worry about the budget, OT for local LEOs?

    What type of umbrella control is then allowed?

    I believe the big point for Chester is that it gets them state police assistance.

    even beyond that, one interpretation of that statute is that you must have an LTCF *and* be "actively engaged in a defense of that person's life or property from peril or threat".

    this is the interpretation that is outlined in the MPOETC training update. (see the first paragraph under "The exceptions to open carry are as follows" on page 1).

    in other words, even with an LTCF, you cannot, under this interpretation, carry unless you are actively engaged in defense.

    it seems like a ludicrous interpretation to me, but just remember that there is a current case going on where a judge has ruled a PA resident can be charged with illegally carrying even though the person has an out of state permit from a state with which we have reciprocity (and that person is still sitting in jail). and this is far more clearly legal than carrying during a state of emergency if you are not actively engaged in defense.

    unless you want to be the one to be the test case, i would suggest CCing during any declared state of emergency. if you want to OC and test it, good for you, but just go in with your eyes open.

    (btw, CCing would also be disallowed under this interpretation, but there is less of a chance any police would notice.)

    Is the whole city in S.O.E. or is it just certain areas they are enforcing it? The papers make it sound like its only a few prime areas that are being enforced.
