Red face Re: Want to purchase firearm but diagnosed with mental disorder. Details inside.

I finally have an update! Took me longer than I thought, but I got it done.

So I was 302 petitioned. That's where police detain me and send me to the hospital for evaluation. Only the evaluating doctor is able to slap on the 302. Because he decided involuntary inpatient commitment was unnecessary, I was never in fact 302'd.

A month later I voluntarily committed myself to inpatient treatment. Again that allows me to legally own firearms, because I was never involuntarily committed for inpatient psychiatric treatment.

So I'm clear. Lawyer also said that if I was in fact involuntarily committed, I would not have passed PICS.

    Thanks guys!

Oh, and I will responsibly handle these firearms. I promise.

Good thing because with a 302 you will NEVER be able to purchase a firearm. Sorry...........

Just hope the PSP does not realize their mistake. You committed a crime.
This is not the law at all. 302 are not considered mental health commitments because there is zero due process. a 303 or 304 likely would be prohibiting. That said, historically PSP has unconstitutionally treated 302 as prohibiting, and he should absolutely speak to a lawyer. The 302 being prohibiting is still on the books, but IMO it is going to be hard for judges to uphold it considering the federal ruling.

Oh yea, I know. I've already taken them. My local firing range invited me to be a member, which is invite only based on how safe and a regular customer you are.

Give me a break. This is a recent change.............the ruling you referenced was filed 12/21/17 and my original answer saying he was prohibited was on 11/14/17.

Amen on welcome to PAFOA and gun ownership!

    Kudos to Phil!

    Group consensus advice:
    Vote conservative!
Go get a License to Carry Firearms. It's $25 well spent.
Do NOT volunteer information about being armed to a cop if you are carrying concealed.
Buy a good holster if you are gonna carry.

    Glocks Rule!
    No, 1911's Rule!

    .45ACP Rules!
    No, 9mm Rules!

Folks, What else did I miss?
