    Man charged for leaving firearm in casino's restroom

    PLAINS TWP. – A Hazleton man was charged for leaving a loaded firearm in a men’s room at Mohegan Sun at Pocono Downs casino.

    State police gaming enforcement unit charged Anthony Mope, 80, of Thirwell Street, with reckless endangering another person. The charge was filed with District Judge Diana Malast in Plains Township on Thursday and mailed to Mope.

    Mope could not be reached for comment on Friday.

    According to the criminal complaint:

    A casino employee cleaning restrooms found the firearm on the back of a toilet at about 3:40 p.m. on July 3.

    State police said the firearm, a .45-caliber, had a full magazine with a round in its chamber.

    Mope said he used the men’s room and removed the firearm from its holster. He placed the firearm on the back of a toilet, and forgot it when he left the restroom, the criminal complaint says.

    State police said Mope was recorded by surveillance cameras entering the men’s room at 2:31 p.m. and exiting three minutes later.

    Surveillance cameras recorded 28 people entering the men’s room from 2:34 p.m. to 3:40 p.m. when a casino employee found it, the criminal complaint says.

    State police said in the criminal complaint that the firearm was available to anyone who found it, including a person not permitted to possess a firearm.

    Mope told state police he was unaware that firearms are prohibited from casinos.

    Douglas Harbach, spokesperson for the Pennsylvania Gaming Control Board, said in an e-mail that firearms are prohibited from casinos.

    A preliminary hearing is scheduled on Aug. 17 before Malast.

    I have been in this casino many times. I look for some signage each time I go. I have never been able to locate a sign.

    Don't think it matters. Example of no sign would be a post office's (only) parking lot. It's considered federal property but neither post office in my area has a no gun sign at the lot. The 1st sign is at the building entrance.

    They're supposed to be at every entrance. Its usually in the vestibule between the outside and inside entry doors. Its usally a sign full of verbiage (not pictorial) about entry conditions and gambler's help.

    058 Pa Code§ 465a.13. Possession of weapons within a licensed facility.


    (a) Individuals, including security department personnel, are prohibited from possessing any deadly weapon as defined in 18 Pa.C.S. § 2301 (relating to definitions), stun gun or other device designed to injure or incapacitate a person within a licensed facility without the express written approval of the Board.
    (b) The prohibition in subsection (a) does not apply to:
    (1) Pennsylvania State Police assigned to its Gaming Enforcement Office.
    (2) An on-duty officer or agent of any local, State or Federal law enforcement agency when the officer or agent is acting in an official capacity.
    (c) To obtain approval for the possession of a deadly weapon, stun gun or other device designed to injure or incapacitate a person within a licensed facility, an individual shall be required to submit a written request to the Board which includes:
    (1) An explanation of the compelling need for the possession of the deadly weapon, stun gun or device designed to injure or incapacitate a person within the licensed facility.
    (2) If the request is for possession of a firearm as defined in 18 Pa.C.S. § 6105 (relating to persons not to possess, use, manufacture, control, sell or transfer firearms), proof that the individual holds a valid license to possess the firearm.
    (d) A slot machine licensee shall post in a conspicuous location at each entrance to the licensed facility signs that may be easily read stating the following:
    The possession of a deadly weapon, stun gun or other device designed to injure or incapacitate a person by any person within this licensed facility without the express written permission of the Pennsylvania Gaming Control Board is prohibited.
    I've seen them in Harrah's Chester and Hollywood. If they are not posted then the casino licensee has violated Pa Code as well as a licensing provision.

    anyone have the link to the law stating it's illegal to carry at a casino? I know there's a regulation against it but where is the law

    Am I missing something. I see where it says you must post slot license but nothing about posting gun bans. Does the actual license state no guns?

    There have been previous threads about this issue... carrying in a PA casino....if anyone cares to search them out.

    Thanks for the info. Was just told PO parking lots were a nono buy a Utah course instructor. I do have a problem with him not being able to tell you where it's in writing.
