    Default PA Mom charged with buying guns for son

    Are the charges because her son was 14?

    As a parent interested in taking my son hunting next year how would affect me? My intent was to buy a rifle though it would be in my name until he was 18. I would think that if I kept the rifle secured and only permitted use of it while under my control that would be within the law.

    I'm very angry at the spin the media is putting on this. Everytime I've seen this on the news, they fail to meantion that nearly all of those rifles on the table except for one, are BB guns. They're loving trying to pass them off as real "assault rifles".

    I was just watching the CBS news, and I'm furious. They were running their mouth with more typical anti-gun nonsense, about how you can simply order these "weapons" through the mail, at gun shows, and how easy they are to get, ect. It's absolutely ridiculous

    How many people were killed with these guns?

    What crime was committed with this so-called 9mm carbine "assault rifle"?

    How were any of these weapons used illegally?

    Oh yeah... NONE is the answer to all three.

    I believe the charges against the mother, or at least most of them, will be dropped. I *think* the issue is the alleged 22 pistol, not necessarily the rifles.

    I love the fact that although this kid was only taken out of public school a month ago, they portray him to be a disturbed "homeschooler".

    should anything the drive by media does or says shock any of us by now???

    my gut feeling is that the mother was charged based on political pressure and drive by media feedling frenzy on this 'story'.

    perhaps if the teachers and principal was as dedicated to preventing bullying as they are to preaching about global warming and the evils of capatalism this MIGHT not have happened???

    easier to blame the object than the total break down of leaderhsip at this school.

    As far as the guns in his possession goes here's the definition of a firearm
    from Pennsylvania's Uniform Firearms Law. You can find it yourself at:

    "Firearm."
    Any pistol or revolver with a barrel length less than 15 inches, any shotgun
    with a barrel length less than 18 inches or any rifle with a barrel length
    less than 16 inches, or any pistol, revolver, rifle or shotgun with an
    overall length of less than 26 inches. The barrel length of a firearm shall
    be determined by measuring from the muzzle of the barrel to the face of the
    closed action, bolt or cylinder, whichever is applicable.

    And with regards to possession by minors:

    § 6110.1. Possession of firearm by minor.
    (a) Firearm.--Except as provided in subsection (b), a person
    under 18 years of age shall not possess or transport a firearm
    anywhere in this Commonwealth.
    (b) Exception.--Subsection (a) shall not apply to a person
    under 18 years of age:
    (1) who is under the supervision of a parent,
    grandparent, legal guardian or an adult acting with the
    expressed consent of the minor's custodial parent or legal
    guardian and the minor is engaged in lawful activity,
    including safety training, lawful target shooting, engaging
    in an organized competition involving the use of a firearm or
    the firearm is unloaded and the minor is transporting it for
    a lawful purpose; or
    (2) who is lawfully hunting or trapping in accordance
    with 34 Pa.C.S. (relating to game).
    (c) Responsibility of adult.--Any person who knowingly and
    intentionally delivers or provides to the minor a firearm in
    violation of subsection (a) commits a felony of the third
    degree.
    (d) Forfeiture.--Any firearm in the possession of a person
    under 18 years of age in violation of this section shall be
    promptly seized by the arresting law enforcement officer and
    upon conviction or adjudication of delinquency shall be
    forfeited or, if stolen, returned to the lawful owner.
    (June 13, 1995, 1st Sp.Sess., P.L.1024, No.17, eff. 120 days;
    Nov. 22, 1995, P.L.621, No.66, eff. imd.)

    1995 Amendments. Act 17, 1st Sp.Sess., added section 6110.1
    and Act 66 amended subsec. (b).
    Cross References. Section 6110.1 is referred to in sections
    6105, 6115 of this title.


    Now there are specific sections of the UFA were the definition of "firearm"
    is changed to this:
    For the purposes of this section only the term "firearm" shall include any
    weapon that is designed to or may readily be converted to expel any
    projectile by the action of an explosive or the frame or receiver of any
    such weapon.

    While this includes shotguns and rifles it should be noted that it DOES NOT
    include air guns, BB guns, pellet guns or airsoft guns since none of those
    function by an "explosion".

    i dont know that i can jump on the bandwagon that this kid is innocent while he didnt do anything wrong he has to have some issues, i mean theres stuff to prove he wanted to shoot up the school. i do have an issue with a parent being charged for buying their son a rifle.

    My local paper emphasized that that the majority were airsoft weapons.
