He believes the Feds should not be able to infringe or confiscate but it is OK if states do. He cites PA as an example:

"If you live in a state like Texas, if the law in Texas is open carry, so be it,” he adds. “If you live in Pennsylvania where they are more stringent and they don't want you to be able to have a gun other than in your own premises or under lock and key or you have to do a background check, then that's up to them to decide.”

Oh boy, did we do something wrong in Pittsburgh last January? Off premises, not under lock and key? :-)

Mark Cuban, wealthy elitist who can afford full security and can organize his life to avoid threats everyone else fails, has the prescription for curtailing the rights of the common people.

Well, he's sort of right. You can't carry a handgun here without the government's approval, unless you can walk it there. Definitely unconstitutional and one of the major problems with PA gun laws, IMO. Right up there with the character clause. Shall issue... pfft, please.

You must not be old enough to remember before shall issue. You had to know someone or buy someone. A bit of groveling, knee pads. That was bull s. Very few people got one (ltcf) and not too many pocket guns were being made. We are living in the shall issue result of overwhelming choices in the ccw market. It’s easy to overlook the strides made if you weren’t part of the struggle. Constitutional carry wouldn’t ever had a chance without shall issue. Socialists are much more in sync with progressional changes to effect outcomes. Conservatives know they’re right, know it now and demand there correct view to be instantly implemented. People with the long view get derided and name called, and nothing gets done.

Oh yeah, this isn’t a rant against you. Just an opportunity to get a point out there. I sometimes rant on.

So how does Cuban reconcile McDonald vs Chicago?

On June 28, 2010, the Supreme Court, in a 5–4 decision, reversed the Seventh Circuit's decision, holding that the Second Amendment was incorporated under the Fourteenth Amendment thus protecting those rights from infringement by state and local governments

The states aren't any more likely to recognize the plain language of a founding document than the feds. PA already has Constitutional language that's stronger for us, and much less debatable than the US 2A, yet we have state-imposed restrictions harsher than what the feds have imposed on us.

The States are the biggest threat to the 2A, and it is due to the COURTS.
