    Default SP4-113 Required for internet purchase of long gun

    First time poster on PAFOA. I spent a long time searching the archive for this question and found nothing. So, I apologize if this quaetion has been asked and answered.

    This is my first firearm purchase in PA. I purchased a long gun online (from Classic Firearms, NC) and it is being shipped to my FFL. The rifle meets all requirements 18" barrel, 40" overall length with stock, etc. When I contacted the FFL he informed me that I would need to submit both a 4473 and an SP4-113. I know the 4473 is necessary, but I was confused because my understanding of the law is that the SP4-113 form is required only for handgun transfers. Is the SP4-113 is required in this situation?

    Who is the FFL? Because a rifle most definitely does not require a SP4-113. I've received six rifles through the same FFL in the North Hills (my FN SCAR 17S and five PSA lowers - two PA-15s, one PA-9 and two PA-10s), and I've never filled out an SP4-113 for a rifle purchased online and received through that FFL.

    Maybe he just doesn't know what you actually ordered until he sees it? Wait and see.

    If he makes you fill it out when you do the transfer then just fill it out, and add the dealer to your "that's not the guy I will do business with again list". I'm not sure the folks actually getting the paperwork will like seeing a long gun on the form either.

    The form is for use with "firearms". They're defined as:

    "Firearm." Any pistol or revolver with a barrel length less than 15 inches, any shotgun with a barrel length less than 18 inches or any rifle with a barrel length less than 16 inches, or any pistol, revolver, rifle or shotgun with an overall length of less than 26 inches. The barrel length of a firearm shall be determined by measuring from the muzzle of the barrel to the face of the closed action, bolt or cylinder, whichever is applicable.

    If it's not a state-defined "firearm" then it's inappropriate to use the state firearm form. You only need the ATF form.

    There was a time King Shooters Supply was requiring the SP4-113 form along with the 4473 when purchasing a rifle. I'm not sure if they are doing that anymore though. Maybe the shop you are dealing with has similar requirements?

    You can blame the PSP for this due to their past requirement of AR15's needing to be on a SP4-113, but the ATF(yes, that ATF) set them straight. The PSP retracted that practice publicly, but some FFL's don't know the proper procedures.
