Default Man Charged for Carrying on His Own Property

Ive heard of this law but nevr saw anyone charged with it. This stupid law needs to be changed,
but I highly doubt that will ever happen.

I would hope and pray, that a good attorney would be able to get this man cleared of all charges. Once again, we see the victim being made into the criminal. The real criminal in this case might get a slap on the wrist, and that is disgusting!

The sad thing is, by the black letter law, it's clearly illegal to conceal a firearm on one's own property, outside of your home or business (the actual structure), and attorneys aren't allowed to argue for the jury to ignore the law or judge's instructions. Hopefully at least a few jurors can figure that out on their own.

Can't he just say he was open carrying, which is legal in PA anywhere it's not specifically restricted?

That would make sense, except I think it was stated he owned the property but didn’t live there. So, did he walk there open carrying? Probably not and that’s where they’re nailing him. Either way, it’s bullshit.

It would have been best if he said nothing. I was scared for my life, talk to my lawyer.

Jury nullification might be an option.

Is this some dick wad leftist blue county? Does the pos DA have higher political ambitions and is trying to make a name for himself? Agree with Jay Smith about claiming OC. This is an f'd up loophole and the clowns in Hairyassburg should fix it. In the mean time...moral of the story is everyone in PA who's legally allowed should get a LTCF, even non-gun owners. Hope the gentleman has a good lawyer. At least he's "only" charged with the misdemeanor for what that's worth.

That's crazy. I wonder what would happen to some people near me who own the lot next to their residence and never did a joinder deed to make it one. Their alarm goes off and they walk onto their adjacent lot and are mugged but shoot the mugger. That's not their residence but an undeveloped lot they own next to their residence.
