Probation officer just told me she'd take MY guns !
Long story short , my brother's girlfriend just got Probation ..... they both live with me because they can't take care of themselves.
The probation officer came over for her first visit and told me if she saw/found guns that she would take them and i would NOT get them back !
Is that true ? why wouldn't she just take the girlfriend away ?
Why would my rights be violated ?
Thanks for any insight !

Part of the probation is probably not being allowed to have guns in the house. If she lists your address as where she lives, then no guns there. As for "taking them and not getting them back?" That sounds like bullshit, the way it was told to me years ago was it would be a violation for the person on probation and they would go to jail (had a roommate I dealt with this a long time ago). Bottom line is, if you allow them to stay, you have to get rid of the guns. Otherwise you get rid of the person, either voluntarily or involuntarily.

They will take your guns but you can also get them back. They can't just keep them.

Carefully check the probation order - does it preclude "possession" or "residing in a house with firearms"?
In general they would typically prohibit possession and that would require that you secure the firearms in such a way that the person under probation has no access (physical or constructive) whatsoever. The situation is analogous to a prohibited person residing in your house until the probation order is lifted. If properly secured, the firearms can still be in the house with you maintaining exclusive access.
42 PA CSA § 9763. Conditions of probation.
(b) Conditions generally.--The court may attach any of the following conditions upon the defendant as it deems necessary:
...
(9) To not possess a firearm or other dangerous weapon unless granted written permission.IANAL

Re: Probation officer just told me she'd take MY guns !
If i had to choose between my guns and my brothers girlfriend, i'd choose my guns. Let her go stay with her blood relatives.
Also, if they take them, and you can get them back, i hear of a lot of accidents while in police possession.
