There are four primary purposes for prisons: rehabilitation, incapacitation, deterrence and retribution. "Punishment" falls under the wing of the latter two categories.

What I was really trying to get at is that it is pointless to punish honest mistakes. The people you are punishing already learned their lesson - they're already rehabilitated and deterred, and incapacitation is unnecessary as they are not a danger - and the people reading about it aren't going to change their behavior as a result (though we'd like to pretend otherwise).
Killing someone is not an honest mistake. The two young guys I mentioned earlier were unfamiliar with weapons, and did not know the basic safety rules. A police officer should never cover a human being with a firearm without absolutely knowing it is unloaded. Even blanks can cause injury. I think behavior WILL change as a result of this. No more actual weapons used in demonstrations by LEOs, at least in this department.

By the way. Both those young men learned their lesson, and will both never even look at another firearm, even if they were not prohibited now, as they both killed a childhood friend, as a result of an "honest" mistake. They were both found guilty, and are in prison.

I guess that explains the multi-DUI driver.

Unless someone purposely got drunk and then drove, it was an honest mistake. Yet for some, it happens over and over again. But hey, no point in punishing them.

Everyone gets drunk on purpose unless somebody spiked your drink with alcohol.

Getting drunk is not the same as drinking alcohol and being over "the limit" that defines DUI.

Plenty of people find themselves over the limit without "getting drunk" by any standard that non-legal people use.

He also plead not-guilty as his arraignment.

Thanks for the update (again), I am very interested to see where this goes.

Uh oh, cop is fucked: http://www.nbc-2.com/story/34878852/...ademy-shooting

Here comes the fail train, there's a lot of fail here. Sadly, I can see their defense, they're going to try to claim that it's the fault of someone else.

Read the article. These people shouldn't have been teaching anyone.

So the department routinely uses real guns with blanks for training, and he was given a box of blanks that weren't blanks by someone else in the dept. Sounds like criminal negligence all around.

I'm expecting the jury will be stupid enough to believe the BS. I have never seen a blank round that looked like real ammunition.

Oh I don't know about the stupidity of the jurors. A good legal defense team can make otherwise reasonable jurors believe that criminal charges are not justified. All 12 jurors must be convinced, and there can be doubt placed in at least a few, a number much lower than 12, which is all that it will take. The prosecution and defense team could be possibly working on a plea arrangement. Obviously neither side wants to lose this one. With a room full of lawyers, stranger things have happened.
