I seem to remember when Aitkens got his conviction overturned, the HP charge stuck, but IIRC because it was a NJ law it didn't effect NICS. But since she would have to pass PICS I have to wonder.
Aitken was convicted of three charges, had his sentence commuted, and had two of the three charges overturned on appeal (unlawful possession of a handgun and unlawful possession of a high-capacity magazine), but the unlawful possession of hollow-nose bullets remained. Because of that, and because in NJ that's a 4th degree crime punishable by up to 18 months in prison, he was a federally prohibited person - until recently, when outgoing governor Chris Christie issued him a pardon. Aitken is now able to exercise his 2A rights once again.
With Donna Gracey, since she's been accepted into the PTI program, she will not have a conviction on her record once PTI is completed. Therefore, she will not be a prohibited person.
