Reno County resident orders intruder from home at gunpoint
John Green Most Popular Our Picks
A Reno County man awakened by someone in his house about 4:30 a.m. Sunday ordered the intruder out of the house at gunpoint and then called 911.
Deputies responding to the scene found a truck parked in a tree row behind the house and sat on it, waiting for the owner to return, which he did.
Nicholas Alan Holder, 38, of Nebraska, was arrested on suspicion of aggravated burglary and illegal possession of a weapon for possessing brass knuckles.
According to the sheriff’s blotter and an affidavit read by Reno County Magistrate Cheryl Allen during Holder’s initial court appearance Monday, Christian Miller, 43, of 4409 S. Victory Road, was awakened by hearing someone in the house.
Miller retrieved a shotgun and “began to clear the house,” Allen read.
“He encountered a tall white male in the living room,” the affidavit stated. “He confronted the suspect and advised him to leave. The suspect left.”
A deputy responding to the scene found a white Chevy pickup behind a row of evergreens just south of the residence. After deputies set up a perimeter around the property, Holden appeared in the road and walked up to a deputy.
During a search of Holder incidental to his arrest, the deputy recovered suspected marijuana and a set of brass knuckles.
“I fell asleep behind the wheel,” Holder told Allen during his appearance via a video camera from the jail. “I was trying to get to the house. I knocked, and there was no answer. I was going to use a phone to call the police. It just got out of hand.”
“You think?” Allen responded. “The fact he had a shotgun, you’re lucky to be sitting here today.”
Allen set Holden’s case on her Dec. 4 status docket.
Holden then asked for a recognizance bond so he could return to work, noting he had a wife and three children.
“That would be a no,” Allen said. “We’re talking aggravated burglary, and you had weapons and drugs. I’m not giving you an OR bond.”

Not a classic "citizen with a gun making a difference" thread. But I am including it because it shows how fast the threat of a gun can end a bad situation.

The president of a homeowner's association was arrested over the weekend after allegedly breaking through a glass patio door and hitting a man with a pickaxe, a shovel and a wooden post.
Wade Curtis Miller, 45, was booked on recommended charges of aggravated assault and unlawful entry. He will likely make his initial appearance in Natrona County Circuit Court at 2 p.m. Monday.
Charging papers say Natrona County Sheriff's deputies responded to a home in the 5000 block of Okeepa -- west of Casper on Highway 220 -- for a report of an assault shortly before 6 p.m. Saturday.
The victim, who lives at the home, said two men came over and knocked on a glass patio door. When the victim got up and walked over to the glass door, he saw both men urinate into a generator gas tank.
The victim said he opened the door to ask what the men were doing, and an argument ensued between the victim and Miller. The victim retreated back inside the home and shut the door.
Miller then allegedly used a pickaxe to smash out the glass of the patio door, started yelling and hit the victim two or three times with the pick axe.
The other man, Seth Zupanik, stood outside and watched the alleged assault, according to an affidavit.
Miller had reportedly stepped inside the home to hit the victim with the pickaxe, and the victim held up his left arm to defend himself. Deputies noticed defensive wounds on the victim's left forearm.
Miller allegedly discarded the pickaxe and picked up a large wooden post, which he then used to hit the victim. The victim was able to grab the post and take it away from Miller, though the victim injured his hand in doing so.
Miller then allegedly grabbed a nearby shovel and used it to hit the victim in the right shin. The victim was also hit on the left side of his head at some point during the alleged attack.
The victim told deputies he had tried to call 911 during the attack, but Miller hit the victim's cell phone out of his hand and broke the phone.
The victim yelled, "I'm gonna get a gun" in an effort to scare Miller and Zupanik into leaving, although the victim didn't have a gun. It worked, and the two men took off.
They reportedly went into a house directly south of the victim's home, saying something to the effect of, "We'll get him in the morning."
Through interviews with a property caretaker, Zupanik and his wife, deputies determined Miller was was the man who assaulted the victim. Deputies arrested Miller shortly before 11 p.m. Saturday and interviewed him about an hour later.
Miller confirmed he was the president of the homeowner's association. He claimed to have received numerous complaints about the owners of the victim's property.
Miller told investigators that Zupanik had invited him over to his house, so Miller went over and the two mutually decided to go to the victim's house.
Court documents say Miller admitted to getting into an argument with the victim, then pulling the victim's shirt over his head, putting him into a headlock and punching the victim twice in the left side of his head.
Miller also allegedly admitted to using a pickaxe to break out the glass patio door and confront the victim again, but denied ever going inside the house.
Miller denied hitting the victim with anything other than his fist. He did say he was right-handed, and investigators noted that the victim's injuries were largely on the left side of his body -- consistent with having been inflicted by a right-handed person.
After he broke out the glass door, Miller said he saw a gun in the victim's waistband, so he and Zupanik left. Miller reportedly described himself as the aggressor.

Man says girlfriend's fatal shooting was 'self-defense'
ATLANTA
- A man told investigators he shot his girlfriend in self-defense after police found a woman dead inside his home.
Joe Daniels returned to his house in 2300 block of Abner Place early Monday just after noon Monday after talking to homicide detectives for hours about what happened when he shot and killed his girlfriend, Shondra Hardin.
The 48-year-old woman was found dead inside Daniels’ home from a gunshot wound to the chest, according to investigators.
Police responded to the house around 4:30 a.m. Investigators said calls for help came from inside the home and from concerned neighbors after some sort of dispute. Daniels’ friends said Hardin was physically abusive and pulled knives on Daniel, and even them, numerous times in the past.
"He loved that woman, but it is not that much love in the world. He had to sleep in his car for three weeks and had to wait until she left to take a bath. That man sweet [sic]. This was self-defense," Eric Harris said.
Daniels broke down in tears when he talked about the volatile relationship.
"They know how the woman been treating me for a long time. I don't need to talk about this," Daniels’ wept.
Neighbors said the girlfriend constantly threatened the man and they believe whatever happened was self-defense.
Atlanta Police said officers responded to 18 calls at the Abner Place residence where the two lived just this year alone. They said many of those calls were fight calls.

The State Attorney’s Office has determined that a man who fatally shot another in July acted in self-defense and will not face charges.
http://www.ocala.com/news/20171128/s...ddick-homicide
William H. Markham, 48, died following a confrontation early July 28 with Harrell S. Jeffries, 56, on some property in Reddick.
A report written by Assistant State Attorney William Gladson states that “when applying the specific facts of this case, with the law regarding self-defense, it is clear that the use of deadly force by Jeffries was lawful and no further action is warranted by this office.”
According to the document, Marion County Sheriff’s Office deputies were called to 16375 NW Gainesville Road, Reddick, in reference to a man who had been shot. Deputies found Markham lying in the road. He was conscious at the time.
A neighbor told deputies that Jeffries was standing behind a tree and had a pistol in his pocket.
A dash cam video recording shows a deputy holding Jeffries at gunpoint. Jeffries tells the official, “He came into my house and beat me up and my arm is broken.”
Markham was taken to UF Health Shands Hospital in Gainesville, where he died.
A Medical Examiner’s report stated that Markham was shot twice in the left forearm and three times in the left side of his back, according to Gladson. The wounds were consistent with Jeffries’ story, officials said.
Jeffries, who had injuries to his hand, head and other parts of his body, also was taken to Shands, where he was treated and later released.
Jeffries told detectives that he lived alone in a travel trailer on the property. He said he was in the trailer when he heard a knock on the door. He said when he asked who was there, a voice said “Buck.” Jeffries said when he opened the door, Markham attacked him with a wooden object he described as a bat or tobacco stick.
Jeffries said he knew Markham from work, the report says. He said Markham was yelling at him, accusing him of having a relationship with his girlfriend, and repeatedly hit him with the object until he fell onto his bed. Jeffries said that, while he was on the bed, Markham continued to hit him on the arms and head. Jeffries said as he rolled off the bed he grabbed a pistol and fired several shots at Markham, until Markham left the trailer, the report states.
Jeffries said he tried to call 911 but was unable to do so because he could not unlock his cellphone due to the amount of blood on his hands. Jeffries said he got into his truck to drive away to get help. He said he stopped when he saw Markham lying on the street.
After Jeffries was released from the hospital, he returned to the travel trailer and walked detectives through the crime scene, which was recorded. Officials said Jeffries’ version of what occurred was consistent with the physical evidence at the scene.
The detectives said they were concerned about drops of blood found behind the travel trailer, which led to a cereal bowl in the woods. When he was asked about it, Jeffries told detectives he may have thrown away some drug paraphernalia prior to deputies arriving, the report notes.
Officials said the travel trailer was among several buildings on the property. They searched the area and recovered a stick similar to the one Jeffries described.
Detectives interviewed Markham’s girlfriend, who told them he regularly accused her of cheating on him. She said one time he hit her and chained her to a golf cart. She said he also told her that if she didn’t admit she was having an affair with Jeffries he was going to kill her, the report notes.
No such incident was reported to law enforcement officials, deputies said.
Gladson’s report states that Markham’s family believes other people were involved in his death. Detectives investigated the claims, but did found nothing to prove other people were involved.
Days after the shooting, Jeffries told the Star-Banner that the shooting was in self-defense and that he wished he did not have to shoot Markham.
Markham’s family told the Star-Banner that the dispute was over a woman and that Jeffries used to work for Markham. They said their loved one, who was survived by a teenage son, was a good man and always tried to help people.
Roughly three weeks after the shooting, Jeffries was stopped by a sheriff’s deputy for speeding and was arrested for driving on a suspended driver’s license. The report states that Jeffries had nine prior convictions for driving on a suspended license.
Jeffries could not be reached for comment for this article.
William Markham Sr. said Tuesday that he believes the incident involving his son occurred outside and that his son was jumped by two people. He said he did not believe his son had hit the woman because he had seen her frequently and that, if his son was hitting her, he would have noticed.
For now, he said, he and his family are trying to “pick up the pieces and move on.”
